·6 months agoI was hounded by my accountant last year: he found the Ebay report directly in my tax drawer, and he had me pay 35 percent in the 730 on all eBay sales, as my IRPEF tax rate. I didn’t know anything about it, I sold a ton of inherited stuff, from camera lenses to encyclopedias, and in no time (1500 + 600 euros from just two vintage lenses) I went over the threshold. The accountant never told me that somehow, I don’t know in what setting, I should prove that I’m not a merchant but someone trying to clear out an entire inherited apartment with (for example) a few thousand books that would end up in the landfill! I don’t know what to do anymore, the flea markets don’t want them1 Does anyone know anything?

·6 months agoIt has been over 1 year since the start of this discussion and it seems to me that not much has changed.....
- The thresholds still apply per single account; if sales are split across two accounts, the thresholds are not combined.
- Sales that are paid but later canceled / shipped and then returned are counted.
- The people in charge (accountants) don’t seem to know any more than they did last year.
Your accountant did what he had to do since, as I understand it, there are no specific DAC7 instructions that have been communicated to industry professionals.
Now that you know about these thresholds, find a way not to be caught unprepared next year.
That is, keep your account below the thresholds and keep track of all payments that have been sent to you.
Calculate any reversed payments because they will be included in the count.

·2 months agoBuyer accounts are one thing, and I think you can open several of them (I have no idea of the exact number) under the same name / tax code.
Seller accounts are something else, and as far as my experience goes, ONLY TWO ACCOUNTS WITH THE SAME BANK ACCOUNT can be ACTIVATED.
I can confirm that even this year nothing has changed regarding sales split across two accounts under the same tax code / bank account.
The DAC7 thresholds DO NOT APPLY if the individual account does not exceed 30 sales or 2000 euros.
So if you have two accounts, you could sell 25 items and/or 1900 euros on one account and 28 items and 1950 euros on the other account and be BELOW THE THRESHOLDS for DAC7 purposes.

I read here that the DAC7 thresholds can be bypassed, for the same tax code, by using two different accounts to sell on the Ebay platform, so it is possible to get around the rule by playing with the two revenues, which must stay below 2000 euros. Where does this source of information come from? I thought I had understood that, instead, DAC7 refers to the same taxable person and therefore the same tax code... so if Ebay ALREADY HAS, for two seller accounts, the same tax code, the revenue from the two accounts is automatically added together and, once the 2000 threshold is reached, a report is sent to the agency. I would like to know the SOURCES of what is stated in these messages that say the opposite (which would be a game changer!) and that I read in these posts. ·6 months agoIf you inherited an apartment or garage full of things you want to get rid of but don’t want to throw away or give away, DAC7 hurts you because it doesn’t take these factors into account.
You can sell on Subito with everything all at once, keeping the thresholds in mind, or on other marketplaces like Vinted, Wallapop.
In short, you have 30 sales or 2000 euros for each marketplace on which you intend to sell items.
The thresholds of each platform are separate and are not combined.

The problem is the premise:
If you are selling your used clothes, accessories, or personal items, you do not need to worry about paying taxes on these transactions.
From what I can see in your listings, it doesn’t seem to me that you are selling your personal items.

·11 months agoI'll conclude by saying that an audit by the Revenue Agency is not a certain conviction. It simply means there is a discrepancy between the data they detected and the data you submitted during your tax return. To put it simply, if you declare € 0.00 and then the DAC7 shows that you sold € 2,000 worth of stuff, the likelihood of an audit is very high. If you can then prove that they are all losses from used items you bought years ago, there will be no negative consequences. Otherwise, they will ask you to regularize your tax position with the relevant fines and interest.

·11 months agoI’m reopening this discussion because it’s very interesting.
I’ve gone over € 2,000 in items sold and my DAC7 was sent to the German authorities. Recently I received a tax assessment from the Agenzia delle Entrate, but for other matters, so I have an idea of how they work.
They send a “courtesy” notice in the sense that they ask you to justify the incoming amounts they found on the accounts registered in your name and they want the relevant documentation. So for your tax code they know exactly which accounts you own and how much you’ve collected each year; it literally says “No. of accounts” and “Actual income”. They even track debit cards and show you the amounts of the top-ups made. The banks pass this data on to them, but the Agenzia delle Entrate does not have direct access to account statements; they only know the final total of the receipts. In the notice, anyway, it says they have already checked any winnings, capital gains from investments, inheritances, etc. and still considered that your position is not consistent with your tax return.
You can then reply via certified email by sending the account statements and justifying **every single transaction**. I mean, you received € 10 from eBay? You have to explain what you sold.
In my case, the € 2,000 were accumulated by selling only used items that I had previously bought on Amazon and then resold at a loss, meaning I lost money, and quite a lot.
Here’s an example:
I bought item X for € 2170.78 on Amazon (with invoice) and sold it on eBay for € 1050.00, obviously taking a loss. You’ll need to send Amazon’s purchase invoice to the Agenzia delle Entrate and match it with the order sold on eBay. You’ll need to do this for every single transaction because, when the assessment arrives, they will ask you for the account statements and you will have to provide them... so there’s no way out.
Just to be clear, the email with the defense brief I sent to the AdE had 104 attachments to justify every single incoming transaction; I also attached all the account statements for every one of my accounts in the relevant period. They called me back from headquarters saying they had accepted my defense request, telling me that I won’t have to go to their offices and that the data I sent are sufficient.
Now, in the case of an abusive seller, how can they justify their incoming transactions across all their bank accounts? I mean, where did they get the products they sold? They probably won’t be able to do it, and the AdE’s investigations will go on until tax evasion is proven.
Of course, it’s always better not to provoke the AdE and stay under € 2,000 and 30 items sold..

·1 year agoeBay mistakenly calculated 31 sales for me instead of 29, resulting in a report being sent to the tax authorities.
The two extra "sales" are actually two items ordered by a buyer but NEVER SHIPPED that eBay incorrectly considered DELIVERED.
After ordering and before shipping, as agreed with me, the buyer wanted to cancel, but since eBay showed them as (incorrectly) delivered, he had to request a refund through the return process (even though there was nothing to return, since the two orders never went out).
Obviously I granted the refund without asking for the items back (there was nothing to return, the two items had always remained in my hands) and the buyer got the refund.
After that the buyer placed another order in which he bought the two items together with a third one.
This last order was counted correctly, while the 2 orders mentioned above were also incorrectly counted (normally a paid but never shipped and then canceled order does not count, as I verified with another order and as they also say)
Moreover, all this initially happened because the buyer wanted to place one single order again in order to pay only one shipping fee and not two, but due to an eBay error in calculating the shipping costs when choosing the new Poste pickup-point delivery option, eBay had generated two orders with full shipping charges. The buyer had gone ahead, but then while talking with me I told him that he could place a single order and pay the shipping fee just once.
At that point I had agreed with the buyer that he would request cancellation so he could place the order for the two items again with home delivery (in that case the shipping costs were calculated correctly only once) as he then did.
It’s just that to cancel the two anomalous orders he had to request a return because eBay incorrectly showed them as delivered even though they had never gone out (and no shipping label had been bought).
Moreover, even on that occasion I had already reported everything to the call center, which had suggested this method to me. I had asked whether the incorrect indication of "delivered" could affect anything, e.g. seller status or something else, and the operator had replied that it did not affect anything but there was no way to correct it.
Now I wrote in the "write to us" form explaining everything and asking for a correction also toward the tax authorities and the response was "we checked and there are no anomalies for us...."
I don’t know if anyone has any idea which channel to contact to try to fix this...

That said, I don't think you'll be able to sort out your issue.
Your case should be taken as a TYPICAL EXAMPLE
Maybe a user makes an effort to be careful and respect the thresholds of 30 sales and 2000 euros, and then for reasons beyond the user's control they end up in the circle of the "DAMNED".
If you were to get a fine for exceeding the thresholds, I'd like to see how it could be challenged....... and at what cost in money, time and energy....
Ebay had to create this automated calculation/counting system but it will have to invest more money to do something more reliable that takes into account:
- missed payments
- cancellations for various reasons
- items not delivered
- disputes
- returns / partial returns for multiple items purchased
- ebay, paypal and chargeback disputes
With all these interactions, I see it as quite DIFFICULT for ebay to manage to create an automated and reliable calculation system.
As usual, the seller is the one who has to bear the burden of every problem.

·1 year agoI think they’ll send checks for blatant cases, not for people who sold 40 items for 1,000 euros but, for example, 200 items for 10,000 euros, and here on Ebay (and Vinted) I see plenty who must have reached certain numbers, given the items they sell... anyway, years ago I looked into opening a VAT number to sell on Ebay in a more "aggressive" way and not have any more problems. At Confcommercio they were basically completely clueless.

·1 year agoYou would need a VAT number with the margin scheme, a special VAT regime applicable to those who trade in used goods. It allows you to buy from private individuals and pay VAT only on the price difference.

·1 year agoIt came to me too, even though I made 40 sales. In my case, it’s mainly about used books from when I was studying that I wanted to resell (naturally at a lower price). Just the fact of having to go to an accountant, waste time dealing with all this bureaucratic stuff, has made me lose the desire to sell online any other item I might have at home.
What’s the point of clearing out a room, an attic, or a basement if you then get reported to the AdE?

·1 year agoNeither the accountant nor the Caf (with whom I spoke this morning) had any idea what I was talking about... basically, I knew more than they did. This is what worries me most: not knowing how to go about it. Unfortunately, it’s all at the authorities’ discretion and until September (when cross-checks with tax returns are done) there’s no way to know what will happen.
Even on the web you can’t find any information, this thread seems to be the only Italian source on the matter.
If you find out anything, let me know.

·1 year agoIt is not considered a crime to sell 30 or more personal items, sleep easy, the rule is new and it does not mean that all the countless private sellers who exceed the modest 30 sales/2000eur in annual revenue are reported yes but certainly not all will be fined or penalized, even tax professionals today have no answers on the matter, ergo no point worrying yourself sick before you've even broken your head.

·1 year agoRegarding the issue of the “calendar year,” the eBay page “DAC7 directive and platform tax transparency law - reporting obligations for sales” (which clears up quite a few doubts on other issues too) says:
“Only reports reflecting sales activity between January 1 and December 31 of the previous year will be sent to the tax authorities. No report will be sent if you have provided your tax code but did not meet the DAC7 thresholds in the previous year.”
So in theory, if someone started selling in April, at least not all transactions are counted up to April of the following year, but only up to December 31 of the current year.

I think what matters are the reports that eBay produces and sends, so I’d take those into account.
If I click on current year, it means the sales are for 2025
If I click on last year, it means the sales are for 2024

OP1 year agoCalendar year in the sense that it has to be counted from the day the first sale was made to the same day the following year? (e.g. I sell for the first time on June 12, 2024, do I have 29 sales up to June 12, 2025?)

Sorry, but I hadn't seen that you had mentioned me (I'm often in a rush).
If you look at the reports that eBay makes, it takes into account
Time interval: 1 Jan 2024 00:00 - 31 Dec 2024 23:59 CET
So if you make your first sale on June 12, 2024, that means you have about 6 months left for the calculation of the 30 sales / 2000 euros.

·1 year agoIf you only made 29 sales between November and December 2024 and did not exceed 2000 euros in sales then you definitely did not receive the email from January 20 with the subject: We are preparing your tax transparency report for 2024
As for 2025, if you managed to make 29 sales in a single month, I find it hard to believe that you will be able to stay below the DAC7 thresholds for the whole current year.

If you were trading illegally, it's better to ask your accountant.

·1 year agoIt sure takes away the desire to sell, I completely agree, but from what I can tell, there are countless private sellers who have exceeded the limit/threshold of 30 sales and/or €2,000 in annual revenue; in my case, 51 sales and income of about €1,650 (€350 in shipping costs), so we’re talking about minimal, negligible amounts (considering that the goods I sell are my property), both used and new, even if vintage and therefore old. I asked my accountant for info and apparently it’s useless to worry before there’s anything to worry about (no one today, including accountants and professionals, will be able to give an answer on the matter, also because, since this is a European law, each member state will apply its own conclusions); the fact remains that we will all be reported, so all that’s left is to wait... meanwhile, as soon as eBay sends the PDF report by email with each private seller’s sales, all that will be left is to hand it over to your accountant and/or tax professional and ask for more detailed info about it... let’s hope for the best!

·1 year agoI agree with an automatic tax, it would be the only solution, but someone on the flat-rate regime pays 5% on 40% of revenue for the first three years and then goes to 15% on 40% of revenue... if I have to pay 22% on 100% I want the rest to go into a pension fund and with the difference.. a plate of snails Parisian style, thanks 🙂

·1 year agoA computer can cross-check millions of data points in just a few seconds... they’ll send compliance letters and if you’re not able to refute the anomalies found... all you’ll have to do is pay!
For me, on the other hand, they’ll catch a lot of them...

·1 year agoIn my opinion they should only put the annual limit of 30 items and remove the 2000 euro limit.
Maybe they should charge 22% like VAT (10% seems a bit too little to me) but the problem is that then there would be a lot of (real) private individuals who would get burned, and that wouldn't be fair.
To get around the obstacle the state should COME UP with a tax on online sales for everyone who doesn't have a VAT number.
Tax on online sales of 22% that the marketplace collects directly.
Otherwise we won't get anywhere because as you say there are millions of private sellers to check who LEGITIMATELY sell their branded clothes and more online.
What do you do with a 2000 euro limit when a full branded outfit can cost over 5000 euro and just a Gucci handbag 2000 euro and up?
I'm glad that awareness of the problem is being taken, but in my opinion we're still at sea.

·1 year agoLook, having sold many of my used books and comics, I’d remove the “limit” of 30 instead; if someone has a big comics collection, maybe they sell 50 to “cash in” 100 euros, and then they get reported to the tax authorities?

I received the email because evidently I went over the thresholds
To answer your question and use it as data to process, I’d say that if you sold 50 items and didn’t receive the email from eBay, it means that in your case eBay only took into account the amounts for which you did not exceed the thresholds.

·1 year agoI read that there are a whopping 7 million Italians active on Vinted; let’s say even just half of them are selling—can you imagine the amount of data that would have to be checked? In my opinion, it would be enough for the state to tax every sale on Ebay, Subito, Vinted, etc. by 10% and call it a day... do you know how much money they’d recover?

Because the occasional seller who wants to get rid of that item they no longer use has to pay 10%, while the rogue seller who sells daily items they buy specifically to resell and does it as a private individual doesn't?
That doesn't hold up and it's not at all fair!

·1 year agoThe fiscal year begins on January 1 and ends on December 31.
And the 730 or PF income tax return for income in 2024 (that is, the one that concerns private citizens without a VAT number) must be filed by September or October 2025 (if the deadlines stay the same as this year).
Needless to say, eBay will notify the AdE in the first few weeks of 2025 if the user has exceeded the DAC7 limits during this year.
In addition, the user, in their personal area, will also find a PDF “copy” of the one sent to the AdE so they can enter this income (that is, eBay sales) in the appropriate line of the 730.

·1 year agoUh, it doesn't work like that! If someone has sold their own used stuff, they don't have to pay any taxes, but if they figure out that someone has an "illegal shop," they could slap you with a huge fine...to put it bluntly

·1 year agoTo sell new Instax on an ongoing basis, you have to be a professional seller with a VAT number, etc...
So in your case, if the tax agency carries out an audit, they will contest the lack of a VAT number, and the fine will be around 500 euros per year (they can go back up to 5 years). On top of the fine, you will have to pay taxes on everything (not just the amount over 2K) and you may also have to pay the minimum social security contributions (around 4500 euros per year).
The gdf could also fine you around 200 euros per listing for not having published the VAT number.

·1 year agoIt's true that by calendar year one means the 365-day period that begins on any day of the year, but I think in this specific case it refers to the period 1-1/31-12, as Ebay itself says. On the other hand, the request has tax purposes (VAT number, personal income tax, social security), which I think should, precisely, take into account the tax years (January/December).

OP1 year agoIt should report the data toward the end or beginning of the year. As for sales in 2025, the 29 transactions are in a calendar year, so it should start from the day of the first sale through the following year (if you made your first sale of 2024 in March, you have 29 transactions or 2000 euros available until March 2025)

·1 year agoFor now, the idea of an enormous database is just a guess.
And it’s supported by the fact that only eBay won’t ask for tax data (because it already has them... it had already “gotten ahead” of things three years ago...), while the other platforms are only asking for them now from those who have exceeded the limits.
Discogs started in September and Vinted last month.
Subito has only issued a statement saying it will do it, but for now it seems that no requests have come in.
It’s clear that once people are “cataloged,” users are always at risk because, even if next year they won’t exceed the limits on individual platforms, there’s still the risk that the huge database mentioned above will be updated anyway, transaction after transaction.
So, as I said a long time ago, the first “effects” of DAC7 will be seen next year around September, when the tax authority will cross-check the platform data with the 730s of those concerned.

·1 year agoAt most, they’ll ask you to pay taxes on it, it’s not the end of the world......
But the fact is that many sellers don’t even show up at all; they’re unknown to the tax authorities.
I’ll give an example like there are so many in Italy.
Unemployed sons and daughters who live in the second home registered in their parents’ names; they’re listed as having nothing and have never filed a tax return.
They sell online with a certain amount of success and have their own network thanks to various hobbies and passions......
Once the DAC7 thresholds are exceeded, it’s not easy for the state to collect money from these users.
If you’re someone who regularly files a tax return, things are much easier.
If they want to crack down on everyone, they necessarily have to tax immediately and directly at the source.
Otherwise, as things stand, the state would have to use resources it doesn’t have to fine or make people pay taxes who may have never dealt with the tax authorities.
If things stay this way, I see it more as a supposed deterrent than anything else.

·1 year agoAs I wrote at the beginning of the dispute (mine might have seemed like an ironic reply, but reading between the lines it really wasn’t...) it’s all at the discretion of the AdE next year.
