User
Hello, I would like to report that the user in question, by contacting me today (and without identifying themselves further), asked me whether I have a VAT number and then stated that they had added me to a very long list of "tax evaders," which they would take the trouble to hand over, in due course, to the Revenue Agency. Since in my opinion this is nothing more than a bad-taste joke, but still worth reporting, I contacted eBay, which only suggested that I not give any weight to messages from strangers that do not concern the buying and selling of items. It is true that I have an eBay shop, but as a private individual, without a VAT number, I do not exceed the sales threshold allowed by current Italian law for occasional sellers (500 €/month). I wonder whether any other user has had similar experiences.

OP1 year agoHi, thanks for giving me a more thoughtful answer. I wrote a lot in the heat of the moment. I see that someone wisely decided to remove the supposed “sinner”; I’ll stick to the rule if certain unpleasant things were to happen again in the future. I’ll try to find out more.
Best regards.

Come on! Are you making the Italian laws ad personam for yourself?

·1 year agoI’m curious where you found this threshold........ playing Monopoly or some other board game?
....as coincidence would have it, these days Padrino IV (known as the Pope ... ) contacted me, making similar claims.....

OP1 year agoThanks for your contribution, but I’d rather focus on more positive and constructive replies.

·1 year agoapparently you prefer to focus on.... nothing
anyway, to conclude and in short:
if there is a user who wrote to you what you claimed, the report stopped at the one made to Ebay support..... here on the forum it is not allowed by the rules to identify the account (in short, you name the sin, but not the sinner.... ) ;
the continuous sale of used items ( ..... especially in considerable numbers.... ) has a specific term in trade: it's called a second-hand dealer...... so, in the event of an inspection by the Tax Agency, it will be up to you to convince them otherwise.......
lastly, you do not cite the legal source for the supposed threshold you mention (as other users said, it is practically the equivalent of hot air..... ) : but Christmas is now approaching, evidently everyone decorates the tree with the balls they want....
then I'll stop, I prefer to focus on other things.......

·1 year agoIt would be useful for the whole community if you also wrote the source of the bullshit you wrote...
With 1099 active listings, you're not occasional at all...
Good luck!

OP1 year agoHi, thanks for your reply, I’m not citing the exact source of this information (which I think you doubt) and whether you’re an expert in tax matters I don’t know, but it’s what was also confirmed to me by the CAF. In any case, thanks for the good wishes.

·1 year agoInstead, it would be very useful for the whole community that reads this... because as it’s said like that, it’s just hot air... and I advise you to go to an accountant or change Caf.
Have a nice day.

OP1 year agoYes, one could, anyway, discuss the concept of "occasionality." My listings consist largely of used books and magazines, which I have always been, and first and foremost, a huge consumer of. This is not a catalog of new electronic gadgets sold in series. So, before talking nonsense, think about your own first. No hard feelings.

·1 year agoThere’s nothing to discuss at all, Italian law is crystal clear, maybe knowing it doesn’t suit you!!
To classify an activity as occasional, it is essential that it meets certain requirements:
So, you have 1099 active listings with no expiration, you have items declared as new so bought specifically to be resold, you have a shop on eBay... for you that’s all occasional??
As for income from occasional activity, this is governed by art. 67 of the TUIR (D.P.R. no. 917/1986), in particular letter i) provides that among miscellaneous income are included those deriving from occasional activities not carried out habitually.
So, the CAF that advised you... who is it, Topo Gigio??
Good luck!
il_buon_libraio
OP1 year agoI still find these two statements debatable.
a) you have items declared new, so bought specifically to be resold
All my books are bought! So what? 99% of my books are used, that is, they have been read or browsed through, the new ones I may even have left on the shelf and then changed my mind about what to do with them
b) the 1099 listings are active "without expiry", well what am I supposed to do then, clear everything out one month yes and one month no? And why doesn't eBay place any kind of restriction on this?
c) you don't need to own an e-commerce. Fair enough, I didn't know that and if it's true I admit my ignorance.
d) Topo Gigio? No, absolutely not! Back then I submitted a declaration to a CAF CGIL office, and they told me that since these were private goods it wasn't necessary! I'm not making this up.
e) I'll write you a quick private message because I absolutely don't want to be put on the spot based on a personal situation that you know nothing about!
sika700
·1 year agoThe items marked as "New" imply that they were bought specifically to be resold; alternatively, there is the "Like new" condition, which is much more suitable in your case.
This indicates continuity, habit, and therefore non-occasionality... the word "occasional" means that the situation happens by chance, not intentionally or deliberately sought.
So you can see for yourself that an organized system like yours does not at all indicate occasionality... that can only be the case for two or three listings a month, precisely, by chance.
It’s not a matter of private goods, obviously you didn’t explain your modus operandi to the clerk, it’s a matter of numbers, as already indicated above... even if you sell used goods!
Better to write in public, nothing to hide, if you’ve put yourself out there on a forum... a public one, precisely... maybe the community may be interested... or maybe not...
Have a good day.

·1 year agoI agree with what sika700 said, writing privately is no use, this is a public and free community, where we discuss many things openly. Almost always the answers, if they touch on "sensitive" topics, are not liked by the people asking the questions, and exhausting debates begin, often lacking logic; even more often the person answering gets insulted and even threatened.
The people asking then disappear, pleased with their outburst and careful not to help anyone, and the person answering keeps doing their "job" instead, purely voluntary and unpaid.
il_buon_libraio
OP1 year agoNo problem, don’t worry, I’m always available to discuss things publicly, as long as it all stays within the bounds of a civil conversation. Right now, though, I have to step away. I’ve already written to sika everything I truly felt in my heart; the need was just too strong. We’ll talk again when things are calmer.
il_buon_libraio
OP1 year agoAlmost always, when the answers touch on "sensitive" buttons, they don’t sit well with the people asking the questions
Listen, to me a person can answer however they see fit. Is substance more important than form? Fair enough. But these "sensitive" buttons, as you call them, don’t you think they also concern the WAY and the TONE in which you answer? I don’t know if I’ve made myself clear... Almost never is the fault only on one side.

·1 year agoFor DAC7, however, other "numbers" apply, and you have already gone past those.
So it will be up to eBay itself to communicate your data to the AdE.
With that premise, you can safely ignore the threats in question made by that user (a name, though, that I’d recommend you delete...).
Evidently they have nothing better to do, especially since reports of this kind made anonymously to the AdE are practically ignored.

OP1 year agoThanks for your kind reply. Yes, that’s true, the limits have been exceeded, I had already looked into that. But I don’t understand why on earth a threshold of 200 euros should lead to tax trouble. I really find that ridiculous.

·1 year agoThere are no permitted sales thresholds if the books you sell were purchased for this specific purpose.
