Product purchased from Germany, never shipped
Good evening, a week ago I bought a computer from a German seller with 0 feedback but 4 completed sales.
He accepted my purchase offer and before I paid he asked me for the shipping address by message, which I provided. The total paid is €61.99 split evenly between shipping costs and the price of the item.
After a couple of days I contacted the seller asking when the shipment was expected, and he replied that he would ship it next week (this one). Yesterday I contacted him again and he told me he had had some problems and to trust him, that he expects to ship by the end of the week; at the same time I pointed out that eBay shows the computer as arriving between May 16 and 17.
Today, fed up (and having smelled a scam), I contacted him again, saying that if he is unable to ship it (or does not want to) he should proceed with canceling the order and issuing a refund at the same time.
By doing this I think I may have shot myself in the foot, since now he has marked the item as shipped without obviously providing a tracking code. In addition, he wrote me a message saying once again that he will ship it and not to worry.
Since today is the last day of delivery, I intend to open a dispute with eBay and, since no tracking code was attached, I should get an immediate refund; moreover, I would like to leave negative feedback right away.
Incidentally, the seller indicates shipping time as 3 days from payment, as shown in the attached photo.

OP3 years agoShortly after midnight I was able to ask for eBay's intervention. I simply wrote that the seller does not intend to ship the item and that they did not follow up on my request to proceed with the refund.
Just now I received the full refund and immediately went ahead and left negative feedback in both English and German.
It's now at -1, we'll see whether eBay does something more or just keeps selling without problems.

OP3 years agoEven yesterday the seller will refund me or ship tomorrow.
By the way, I noticed that he completed a fifth sale. I tried to contact eBay customer service but:
1) they don’t have access to the messaging with the seller; in fact, they told me he marked the item as shipped but did not provide any tracking code, and it was no use saying he didn’t ship it as stated in his own messages.
2) I still have to wait until the 24th to get my money back after eBay’s intervention.
Basically, a person has to stay on the hook for 3 weeks dealing with the runaround from a seller who, by the way, has 0 feedback.

·3 years agoI imagine that if you bought from someone with zero feedback, it’s because he was the only one who had the item you were interested in at the price you were interested in.
If he has already marked the item as shipped, you have to wait until the estimated delivery times have passed before you can open a claim for item not received.

anyway the rules are pretty clear;
in short, the steps are:
open item not received after the delivery deadline indicated in the listing has passed;
after the aforementioned opening, wait, if after 3 days the seller does not respond or you do not find an agreement, ask eBay to step in

OP3 years agoWhen I buy from China, I'm aware of the delivery times.
Oh well, let's hope we can wrap this up tomorrow and finally leave a negative feedback (provided they don't manage to get it removed after all).

the fact remains that in any case you have to look at the listing and the times indicated by the seller ...... in fact, nothing stops the seller from stretching out the delivery times and consequently having to postpone opening a dispute in the event of non-delivery
I’ll reiterate anyway: if the seller keeps going like this.... I think their account will have a short life from a sales point of view

OP3 years agoGood evening, the conversation has continued (at the bottom of the dispute). I clearly told the seller that if he does not intend to ship, he should proceed with the refund.
In the second-to-last message he wrote this to me:
"Hi I understand that you are angry I can give you the mouse and keyboard for free I intend to ship the pc only with the money it’s not easy at the moment if you can be patient otherwise I will refund you and I know well you certainly do not want to joke Kind regards"
So I replied to stop taking the mickey out of me and to refund me and I got this response but not at the bottom of the dispute, as a message:
"Hi don’t worry they take their PC but from a human point of view they are really not nice and do not understand well you can’t do anything some people are so kind regards"
Do I really have to wait until the 24th to get eBay to step in? To me the taking the mickey seems obvious.

·3 years agoI don’t know if it’s a "rip-off"; the fact is that a seller with zero feedback doesn’t get the money immediately but has to wait, and if they make a lot of sales at the same time it means they have to front at least the money for several shipments.
Obviously these problems shouldn’t concern the buyer, who "rightly" after paying wants the item shipped to them within the timeframes shown on eBay.
Anyway, if you buy from someone with zero feedback and you know the new rules, you have to be aware that situations like this can happen.
So yes, you have to wait patiently for the times set by the procedure.

OP3 years agoAll very true if it weren’t for the fact that he never explicitly said that I should wait 14 days and that he wouldn’t ship until he had received payment.
Anyway, given that I asked him to give me my money back and keep the PC, why didn’t he even go ahead and cancel the order? Lots of nice words, but when it comes to actions, we’re at zero.

OP3 years agoThe seller just sent me this message, whatever that means:
Seller’s message: Hi, I’m sorry, it’s very stressful right now. I’ll send you your PC as soon as possible, and since you opened a case we won’t get the money for the PC you bought until June 18. Kind regards
Basically it’s the same reply (exactly identical) that he sent me on Monday.
Unfortunately I can’t ask eBay to step in until the 25th.

·3 years agoIn other words he would like you to close the dispute so he can receive the money and you the item, but that's not how it works: if you close the dispute you won't be able to reopen it! He won't get the money immediately, regardless of the dispute, if that weren't the case he would already have received it. He's probably a new seller and has to wait for the technical processing time for the credit to go through (and it's long). The fact that he has made sales but has no feedback is telling, it could also be that he never shipped anything, maybe waiting for the credit or maybe he's selling things he doesn't have... who can say for sure? Follow the procedure to the letter and only worry about your refund. eBay will not reverse the completed payment but will send him the charge to the bank account on file and when the crediting period expires the seller will get the amount back. If eBay doesn't find the funds in the seller's bank account, it will refund you anyway and deal with the seller. It's not your problem. If you have to wait, wait without delay. And I wouldn't even reply to the seller since there is an open dispute, communications have to be done there. And if he hasn't shipped, there's not much to communicate.

·3 years agoother users have already replied, anyway if he doesn't ship and doesn't enter a tracking code the risk is all his; in that case open a dispute for item not received;
NOTE: the fact that he asked you where to ship before payment makes me think he's a first-time seller or at any rate not very experienced; in any case either he learns how to sell or soon he'll probably be off eBay .....

OP3 years agoAccording to his profile, he has completed 4 sales on ebay (albeit with 0 feedback), so he should know how the crediting times work. I understand it can be annoying; once I also had to wait 14 days, but I shipped anyway.
That said, I will definitely file a complaint, I just have one doubt: who will read this complaint? The seller or the ebay staff? What language should I write it in?

·3 years agoDon’t worry about what language to write it in... the report starts from eBay, the seller will read it and eBay will take care of handling it, this is the procedure:
Get help for an item that hasn't arrived | eBay
The important thing is to open it, the refund won’t be immediate, if the seller does nothing, on the fourth day you can ask eBay to step in:

OP3 years agoThanks, but depending on who reads the report, I can also adjust what I write.
If eBay staff read it, I’ll attach screenshot proof of the messages and the rest; if the seller reads it, I’ll point out that they’re in breach.

·3 years agoThe procedure indicated above is a formal report, you can’t attach any proof, you only have to "fill out" the request and if you want, you can provide additional information, optionally.
Personally, if you want to add other info, I would write in Italian (if he wants to translate it, he’ll use Google!).
The seller will therefore have various options... he may do nothing, he may refund you right away, or he may dispute it by providing proof of shipment.

·3 years agoIt could be that the seller marked it as shipped after your messages or because the system automatically nags them with messages reminding them that they need to ship. Wait until tomorrow at least; many sellers as a matter of practice (which I don't agree with) mark the shipment as sent and then ship the next day. Some enter the tracking code in advance, which obviously doesn't show up until the next day; others enter it after shipping.

·3 years agoSure, in your case I’d have more than a few doubts too; tomorrow, if you don’t find a tracking code entered, start the refund process. Do everything through the eBay platform, don’t accept any solution eventually proposed by the seller via message, and once you’ve opened the process, don’t close it under any circumstances or you’ll lose your refund.
If you have any doubts, contact eBay support directly via chat or phone, or post on the forum; someone will reply to you.

OP3 years agoThe seller wrote the following to me very clearly:
So no, he has no intention of shipping tomorrow, he marked the item as shipped just to buy time.
When I sell and use eBay’s shipping manager, after buying the shipping label it automatically inserts the tracking code; he just flagged the item as shipped.
Also, eBay sends the money to the checking account within 3 business days, and here 7 have passed.

·3 years agoI understand, if the expected delivery times have expired, start the claim procedure to get a refund.
As for the money in the seller’s checking account, maybe it won’t reach him before 14 days or more, since he’s a new seller and has the blocks предусмотрi for new or not very active sellers; at least these are the rules on eBay.it, I don’t know whether they’re similar on eBay.de.
Maybe the seller is inexperienced and, not seeing the money credited, is trying to stall; try explaining it to him. But if instead he’s a sly one trying to let the eBay claim deadlines run out with repeated delays, that would be a real problem, so if you don’t trust him, start the claim procedure.
