Hi everyone, I've been an eBay user since 2003, this is the first time something like this has happened to me and I'm very sorry. Two days ago I received a Madonna LP 'Like a Virgin' pressed by Sainsbury in a condition not as described. First of all it's damaged at the corners and then the sticker is missing from the cover, while the seller posted a completely different photo in perfect condition. I've tried writing to him but he still isn't replying, it's really a bad gesture, I can't stand that people can take advantage of others like this. What's more, the fact that he ignores my messages makes me understand that the item was already like that beforehand and it wasn't a mistake.
I requested cancellation and a return but he still isn't replying. What can I do?

·1 year agoWhat do you mean eBay didn’t consider it necessary to step in? Usually, when the seller doesn’t act, the buyer is fully refunded by eBay without delay.
g.ponti90
OP1 year agoIn the sense that he didn't think it was necessary to warn the user and make him change the item's description, something he only did when I filed the 'appeal'
g.ponti90
OP1 year agoYesterday I appealed because Ebay didn't think it was necessary to intervene, so I went ahead and appealed and today it was accepted, probably my reasons hadn't been understood properly. They took the report seriously and I'll get a response in 24h. At this point I hope I’ve put a bit of the shits up the seller, so next time he’ll learn not to sell damaged material that doesn’t match the description

·1 year agoYou can report it to eBay, but I'm skeptical they'll take any action. Let's say once can be a one-off, twice is a coincidence, three times is a pattern.
As Sika suggested, you can return it as a non-conforming product and the return shipping costs will be covered by the seller; in addition, you can point out (politely) that the items received were different from those shown in the listing, so future buyers will be helped too.

OP1 year agoThanks, I pointed out the problem to the seller (politely) and he ignored me, saying he was having problems with his PC and couldn’t reply to messages... I’d say that’s pretty typical

·1 year agoI sent you instructions on the correct procedure to follow, but I seem to understand that you don’t want to return the records following the procedures, since the seller should not be reported, but a complaint should be opened for an item not conforming to the description.
What would you like to do?
Contact the seller to do what? Get a bit of money taken off the total purchase price?
Or receive the seller’s apologies?
If the seller has been negligent, the only appreciable “lesson” you can give him is a dispute.
But then again, picky buyers like that are in the clear minority, so he will continue to maintain this line of conduct.
If you really want to make reports, report in the feedback that the LPs you received are not the ones in the photos.
Sorry for the inconvenience.
Kind regards

OP1 year agoRead carefully what I wrote: the first one has already been sent back, picked up today, while the second one, delivered this morning, must be returned!

·1 year agoWell done, you did the right thing.
Only this way do sellers "correct" themselves from bad habits

·1 year agolet him stew in his lies, open the dispute as you were advised, if the seller doesn’t do anything after 5 days you can ask ebay to step in.

OP1 year ago@vonbalden sure, sure, I understand the dynamics of collecting since I’m also a collector for over 30 years, unfortunately the fact that people act like this ruins the market. But that can’t make them immune to feedback and I’ll definitely do it. Honestly I’ve never left negative feedback because I prefer not to get it back in return, but this time I’ll do it as a warning to anyone who still buys from him.
Attached is the LP that arrived today...
g.ponti90
OP1 year agothanks for the information, I had already done that.
I bought a second LP from this seller, a few days after the first one.
Today the second one arrived too, and with this one as well the differences between what was shown in the photos and what was sold are huge, they’re really not a serious person. Can a report be made to Ebay? it’s ridiculous, I even have to spend money to send this one back too and I’m already at 20 Euro...terrible.

·1 year agoIf the item or items are non-compliant, the return shipping costs are entirely borne by the seller.
Kind regards.

·1 year agoGood morning g.ticozzi90
Go here:
https://www.ebay.it/help/buying/returns-refunds/restituisci-un-oggetto-cambio-di-un-rimborso?id=4041
Click on "return the item"
In the claim form, write that the item does not match the photos in the description, explaining the reasons.
In this case, the seller is required to provide a return label at their expense; if they do not and do not respond, you need to contact eBay support, making sure not to let the dispute period expire without sending the item back.
If you have any other problems, feel free to write.
Kind regards

·1 year agoWithout wasting any more time with questions to the seller who doesn’t reply and, of course, is sure not to reply, open a non-conforming goods procedure and you’ll be refunded by the site. Keep in mind that in the vinyl sector it’s very difficult to sell an item in full satisfaction. Whether because it’s often impossible to listen to the entire recording from start to finish, or because buyers are very demanding about their vintage piece. Unfortunately, many sellers, afraid of not selling their items (since these are records they also offer at flea markets and that fill their warehouses to the brim), look for little tricks. This kind of seller is used to passing customers who, once they’ve bought a record, are never seen again. Even if they have the option to play them on stereo systems, they certainly don’t sit down to listen to an entire microgroove record. Vinyl, because of these issues, is very similar to the used mobile phone sector.
