eBay embezzlement
Hello, I am a private seller, I would like to report Ebay for embezzlement because it refunded a buyer (taking it from my account) who requested a return, sending the return to another person (as shown by the tracking they provided), and therefore I did not receive the package back (an Apple Watch worth 700 euros). I opened a case and after 40 days they refunded because it says delivered!!!!! The problem is that it is delivered but not to me, the seller!!! Basically anyone can ship to a dummy address or a friend and so it shows as delivered and ebay checks nothing!!! I filed an appeal and if they don’t rule in my favor I will file a complaint against both the buyer and the platform, because if it is embezzlement for the buyer who kept the item and the money, ebay also improperly took the money from my account without making sure I received the item back. I also attached the tracking photos showing it was delivered and not to my address and even the photos of the package that was addressed to another person (recovered by the courier) with the tracking number passed off as my return! Truly absurd

·2 years agoAccording to the tracking, the package has arrived at the relevant branch "sda montalto uffugo operations center (cs)"
And then from there it did not make any home delivery.
Or it was picked up at the office and you should check who picked it up.

·2 years agoIn this situation how can you claim that the package was sent to his cousin or some relative of his??
Then at the SDA office only the person in whose name the shipment is registered can pick it up, or else an authorization is needed.
Anyway, this seems like a PRETTY STRANGE situation because from the tracking no unsuccessful delivery attempts were detected, or problems with liquids leaking out of the package, or other issues that required it to be held at the local SDA office.......
In my opinion it would be best to go there to the branch and get documentation on who picked up this package and why it wasn't delivered to the home address.

OP2 years agoBecause the tracking isn't complete, ebay is sticking to what shows as delivered to the office, so I should go pick it up, but there is nothing at the office and with that code it shows as shipped from Palermo to a spare parts shop in my area. That's exactly what they told me at the SDA parcels post call center too, and by the local courier who also photographed the package he had delivered there and that was not in my name. Then, through my friendship with the courier, I found out that basically they received 2 water bottles from Palermo without having bought them. That's why I say that ebay probably didn't even see the proof that the buyer sent me, because it shows as sent to another person, it seems surreal to me. The buyer/scammer obviously isn't replying to me

OP2 years agocustomer service told me to upload the photos as proof first by emailing eBay, then when I said that there’s nowhere that lets me upload photos or files they said to write to the buyer and then they’ll see it

·2 years agoI checked the code, which is a POSTEDELIVERY STANDARD, so the post office should handle the home delivery and/or SDA with home delivery.
There was no home delivery and the code says it was delivered.
It could be an attempt at embezzlement by SDA........
Unfortunately, the tracking is what counts and ebay is not set up to investigate and/or look into the matter.
If the tracking shows it was delivered to the branch in your area and maybe the buyer provided the waybill corresponding to your address, for ebay the case is closed.
I'm sorry about what happened, but if what you wrote is true you need to file a formal complaint with the post office and then also make a report against poste italiane / sda.

OP2 years agoThe problem is that I didn’t send the courier, the buyer shipped it, so he should be responsible for the shipment if he didn’t insure the package and he paid for the service, not me. I think I don’t even have the right to open the claim because the responsibility lies with the person who ships it, and especially if he really sent it to someone else by mistake, SDA shows that it was correctly delivered to someone else

OP2 years agoHe asked me for a non-conforming product. If you can see, I’ve been selling various personal items for 14 years without ever having any problems. I shipped the Apple Watch, taken off my wrist the day I sent it, and the next day it was delivered to Palermo. I attached the Amazon receipt, which still had 1 year of warranty left. After 6 days he wrote to me asking how to turn it on, I told him, and then after another 2 days he opened a claim for non-conforming product saying it wouldn’t turn on! I challenge anyone to receive a smartwatch or phone and test it after 6
days… even that already smelled off to me, especially with Amazon’s warranty, which doesn’t give you trouble. He started saying that he had paid too much for it and that with a little more he could have bought it new, but nobody forced him to buy it. Suspicious, I opened a claim to report the fake buyer, and I also made several phone calls. Then they accepted the return but at his expense because of the claims, to make him back off according to customer service. Then, after checking the code he entered, I saw that it showed as delivered to the SDA office. I checked with the post office call center and with the local courier who does my deliveries, and it turns out it was delivered to an auto parts shop in my town, signed for by an employee who is not me and that is not my address. I appealed last night and just a little while ago they replied again that the buyer provided proof of delivery, but from the tracking it shows delivered to the SDA center in a nearby town and the signature of this man

·2 years agoBut does this buyer live in the area around your town?
Because if this is an SDA error / issue, I don't think you can win the claim.
You should have the buyer give you the waybill to see whether the address matches.
I find it ABSURD that the buyer ships to the town where you live but enters a different shipping address, risking losing the item and the money.
It seems like a rather unusual situation to me.
In my opinion, once you have the waybill that matches your address, you should file a complaint against the courier.

Unfortunately, this is one of the many issues a seller can be exposed to.
In addition to dealing with not-so-honest buyers, you have to deal with standardized / automated procedures that do not detect this type of anomaly.
Contact ebay support via chat and by phone and explain the problem to them.
In any case, it would have been appropriate to contact ebay support IMMEDIATELY right after checking the tracking, without letting 40 days pass, because these problems are not detected in automated procedures.

OP2 years agoI had already written to eBay and called twice, warning them about the problem and explicitly asking them to check and not dare issue a refund, but yesterday the famous standard email arrived saying they had checked that it was delivered and were initiating a refund, it’s a scandal. I appealed and am waiting for a response. At this point tomorrow I can also buy a €1000 phone, then ask for a return and send it to my cousin, who as soon as he receives it it shows as delivered and they refund me and I keep it…

I hope that with this forum post you can get your money back, but I repeat, 40 days of waiting are a lot, I would have written on the forum much earlier, surely the situation would have taken a different turn....

Generally, in a refund case, from the moment the package is delivered to the moment the refund is issued, several days pass, but definitely not 40 days.
If 40 days have passed, it means something happened; maybe support also contacted the buyer, who then made their statements, more or less truthful.
ANYWAY, THERE'S ONE STEP I DON'T UNDERSTAND: You're a private seller and in the auction you wrote RETURNS NOT ACCEPTED, so why are you talking about a RETURN?
For an item NOT AS DESCRIBED, you should be the one providing the return label to the buyer, who otherwise couldn't ship to just any random person.
On the forum, we base ourselves on what the person who opens the discussion says, and we never have the other side's version, which support may have.
