The buyer opened a request because they did not receive the item
Hello, 98 days ago I sold an item on ebay, shipping with Posta4 (that is, untracked shipping). I used untracked shipping because the item sold was of low value. After 98 days I receive 2 messages from ebay:
- the first message says: "Your funds are on hold because of a claim. Your funds are on hold until this claim is resolved" ;
- the second message says: "The buyer opened a claim because they did not receive the item. Respond and resolve the claim as soon as possible".
As far as I'm concerned, since the shipment is not tracked, the buyer may be right and the item really never arrived. So I am willing to refund them or send a second identical item. (Even though it seems strange to me that this person waited 98 days to say the item didn't arrive).
But what I would like to know is this: can a buyer request a refund for an item not received after 90 days? At this point, tomorrow I could wake up and find hundreds of refund requests for all the items I sold on ebay with Posta4 in these last few years ?!
P.S. if I go to my purchase history, and select an item I bought more than 90 days ago with untracked shipping, ebay does not let me select the "item not received" option. How did this buyer manage to open this claim against me?

·4 years agoThe buyer can request a refund for an item not received either directly through eBay or through the payment method they used. Only the timeframes change:
Since the seller is paid through eBay, when eBay receives a refund request, it then goes after the seller.

So basically all the money I earned in my account isn’t actually MINE yet, but for it to really become MINE and no one be able to touch it anymore, I have to wait 1 year from the payment...

·4 years agoAny seller (whether physical or online), who receives a payment by credit card, is subject to this risk.
The user can always dispute the payment: for unauthorized transaction, item not received, not as described, etc.....

·3 years agosorry Mario thanks for the reply so what do you advise me to do, wait until next week and then ask for a charge back? meanwhile since yesterday the seller still hasn’t replied to either my emails or the email from eBay, then I don’t understand the post office if they actually say that Posta 1 isn’t trackable, why then when asked for explanations do they say the envelope was delivered just because the courier marked the shipment as delivered? take my case, the postman has to take it to a tobacco shop which hasn’t received anything so there are also witnesses and what do the post office do? confirm delivery?????????????? just so they don’t show what a cr,,,,,,ap service they offer?

·3 years agoGood evening, I’m replying here (I read your post but it’s in the user support section, and only a very few people can reply there, including Mario).
Did you pay with Paypal? If so, try opening a claim via Paypal, but I don’t know if they’ll rule in your favor since the delivery status could be considered valid. Let’s say Paypal phone support is easier to reach; all you have to do is log into your account, and support is more specialized in claims cases.
Posta1 is by no means a tracked shipment, so much so that Poste lists it as a priority mail service with a delivery status that, I’d say, is fairly random, in the sense that it depends on the good work of the postal worker, who puts an apparent delivered checkmark, but there is no obligation for tracking or signature. To sum up, Posta1 is fast, cheaper than registered mail, and has a delivery status, but if problems come up you’re out of luck; support does not provide help for products like Posta4 and Posta1.
It’s obvious that shipping with Posta1 for 10 euros, if it wasn’t indicated in the listing, is improper practice. If it said registered mail or package you can use that as grounds to support your refund request.
So if you want, before asking for a chargeback, contact Paypal first (if you paid through them) by phone and explain the situation, including the Posta1 issue, and then open the claim through them. If Paypal still doesn’t refund you and the item doesn’t arrive, then request a chargeback as a last resort. PS: with Paypal you have 180 days to open a claim, so wait a few more days.

·3 years agoThanks, I’ll do that, I’ll wait a few more days and then straight to Intesa San Paolo. You know what bothers me? The seller is in Germany, I only got the tracking yesterday evening, because I asked for it on March 2 by email, and I only got a reply yesterday. Worried about the delay, I wrote to her to send me the tracking number, not because I don’t trust her but to check it because the days seemed like a lot to me. I live in central Naples and she’s in Pozzuoli, it’s about 13 km away, so a letter should at most arrive in 2 days; 10 have passed......and so yesterday evening she writes to me and finally sends it, I check right away and see that the shipment shows as delivered on March 1.........I write back immediately and tell her that the shipment shows as delivered, in fact I only found out the tracking yesterday, March 4, and right after it was provided she entered it into the shipment and automatically later it showed as delivered. Since I got no reply to my emails, I opened a dispute; today she replies that she filed a complaint with the post office (useless), Posta1 is not trackable and what does she hope to get? I don’t know, more than that she wrote to me that from the tracking it shows as delivered.........are we kidding? It was me who wrote to her yesterday evening after receiving the tracking that the shipment showed as delivered on March 1, and now she replies with this? Evidently people just want to cash in for a stamp on an envelope, she took 10 euros, but what are we robbing? For 10 euros I take express delivery for the next day
ps so I’m waiting until the end of the week, if I don’t receive anything, neither the package nor a refund from her, I won’t involve eBay but I’ll go straight to the bank, thanks

·3 years agoLook, in your place I’d first act through Paypal (if you paid with them, and I assume you did) as I explained before by contacting them by phone, and then I’d act through the credit institution. That way I’d have 2 options.
The complaints for posta 1 are useless, personal experience. Last year for a posta 1 not related to sales I made 2 complaints and I was only asking where it had ended up because the status was stuck forever “in lavorazione”, I wasn’t asking for any refund, the replies arrived promptly: basically they wrote that for that product it’s not possible to provide assistance and that they apologize for the inconvenience.
So the seller won’t get any help. You just have to hope it arrives, waiting costs you nothing anyway since you have 180 days with Paypal and if I remember correctly 1 year with the credit institution.
