Items sold as a lot were actually sold individually

I found a listing titled "item A + 2 item B", used, not working
Long story short: I thought he was selling all three as a lot, but then checking the listing again I noticed it was still available, with the note "two sold, one left". But nowhere in the listing did it say they were sold separately.
Long story long:
The description included the descriptions of the items, and all the photos showed the three items together.
Since the description was exhaustive, with the issues specified (sold as not working, which is fine with me), I made the purchase.
A little while ago I went back to check the listing, and it still shows as available, with two items sold out of 3.
So now I have the doubt that the seller meant to sell them separately. I’ve written to him for information and to tell him not to send it, since I’m not interested in just one item for that price, and I’m waiting for a reply.
There are the following points that may prove me wrong:
- I could have written before, but I didn’t because the description was exhaustive and nothing made me think the items weren’t being sold as a lot (I’ve often bought items as a lot)
- I should have had the doubt at the time of purchase, but I didn’t notice the field asking me for the quantity (maybe it was there, but I didn’t see it).
There are the following observations that may prove me right:
- nowhere in the listing did it say they were sold separately. The title was product A + 2 products B, so I believe this is a case of a product not matching the description (1 product instead of 3)
- all the photos showed the three items together
- product A is worth more than twice a product B. How am I supposed to know what I bought? There wasn’t a drop-down menu to choose from.
- I wrote to the seller asking them to wait before shipping.
If the seller only meant one product, since it seems strange to me that he has 3 identical lots, regardless of whether the one I won was A or B, I want to ask to cancel the order. In that case, am I right to request cancellation, or even if it wasn’t specified in the listing do I have to keep the one out of the three that he chooses to send me? What if the seller decides to send it anyway?

·2 years agoOnly the seller can decide whether or not to cancel an order; not even ebay can influence this decision.
If something arrives that’s different from what you believe is described in the listing, you can request a return by choosing the reason: The item does not match the description and photos.
The return shipping costs will be the seller’s responsibility, since this is a non-conformity.
If the seller disputes your claim of non-conformity, ebay will decide who is right.
