The seller claims that the package arrived even though the tracking says otherwise
Good morning,
On February 16 I bought an item from Great Britain because it wasn’t available in Italy.
Seller with tons of feedback.
The shipment indicated Royal Mail 24h, but I was on my phone and I don’t know whether I was logged in while I was looking.
I paid and the delivery date was supposed to be February 28.
Initially on eBay the Royal Mail code was shown and on the 22nd it was marked as delivered (I get an email saying signature impossible and there’s a photo of an air pallet).
At the same time I get an email from Pitney Bowes, on eBay the tracking is updated and starts again.
It arrives in Italy at Rho, I get an email from GLS with a new tracking number (but the Pitney Bowes tracking keeps updating with the stages in Italy), it leaves Rho, is in transit and then delivery on February 28.
From February 28 onward every day the tracking updates daily telling me that the package has not arrived at the final delivery branch (Turin) and therefore it was not possible to deliver it.
I call GLS, they tell me that those data are only indicative and to wait the third day and contact the seller.
I contact him explaining the situation by opening the case for “item not received”, in which form I can see both the Royal Mail tracking number and the Pitney Bowes one.
He replies to me twice, simply writing “delivered”, delivery date (2/22), tracking number (Royal Mail).
For him it’s delivered and he washes his hands of it.
I paid by card without Paypal.
He has until the 8th to fix it.
I read that I can ask for the customer guarantee directly from eBay: could you explain how to go after this little scammer?
Should I contact them before March 8 or should I wait?
I really don’t want to lose the money...
Thanks

Without going too far with hypotheses, on eBay things work like this:
You are told the estimated date of receipt of the item.
If by that date you receive nothing, you can open a dispute for item not received.
After that, you have to follow the instructions that appear on the screen.
If you do not receive the item, eBay refunds you.
Obviously, from the tracking it must not result that the package was duly delivered, otherwise you will not be entitled to any refund.
- It must not result that the package was held at the depot and not collected.
- It must not result that the package was returned to the sender.
- It must not result that the package was refused because you did not want to pay the relevant import charges.
So if you run into delivery problems, I advise you to take action yourself by trying to contact the final courier who physically made the delivery.
In the event of non-delivery, the package is held at the local branch for a few days before being sent back to the sender.
You need to contact the courier within this short time frame because if the package goes back, the damage is done.
Best regards.

·2 years agoThe problem is that in this case the seller only takes care of transport until it reaches the fateful Pitney and Bowes. It’s not even certain that he can see the information you can see (unless you’ve shared it with him).
Unfortunately, these are the downsides of this international service. Simple logic says that the more it changes hands, the more problems there can be.

OP2 years agoOn the dispute page, as item not received, I can see both tracking codes, I think he sees that same page too; in any case I also gave him the second tracking number with the link.
In any case, in the end he replied to me with a proper sentence and basically washes his hands of it, saying that he shipped it with Royal Mail to Pitney Bowes, and that for the international shipment I have to sort it out with eBay.
And at the same time eBay, when I opened the dispute, was writing to me to contact the seller and that I would quickly resolve it with him, with the guarantee that after March 8 they would step in to settle the dispute.
Unfortunately the link Mario gave me doesn't work, in the sense that when I select the item of the dispute it tells me that I already have an open case (I suppose they mean with the seller, who doesn't provide me with any assistance, though).
Good to know for future purchases, especially from abroad: all consumer rights trampled on, I have to sort it out myself...

·2 years agounfortunately, that's how it is. In fact, the seller only takes care of shipping it to Pitney Bowes; what can be blamed on them is the choice to rely on this shipping system, but the alternative would probably be that they would no longer ship abroad. Since Great Britain left the EU, I no longer buy precisely to avoid problems like these.

·2 years agoHe’s not a scammer. He did his duty by shipping the package to Pitney Bowes’ logistics center (which runs the GSP program). From there, the package leaves again for the international destination with the second UPAA code……
So, if the failure to receive it wasn’t your responsibility, you can ask eBay for help: https://www.ebay.it/help/buying/returns-items-not-received-refunds-buyers/ottieni-aiuto-per-un-oggetto-che-non-arrivato?id=4042#:~:text=Seleziona%20Altre%20azioni%20accanto%20al,Seleziona%20Invia%20richiesta.

OP2 years agoHello.
Yes, he’s a sly one, absolutely: he’s making a fool of me!
He always replies "Delivered - shipping code - date - Royal Mail 24", when the tracking says "not delivered", completely ignoring the later shipment!
Besides, what responsibility could I possibly have?
The tracking for both GLS and Pitney Bowes says for three days straight "we were unable to make the delivery - parcel did not arrive at the final delivery facility".
I wasn’t the one who chose the courier; otherwise I’d take responsibility for it.
