Buyer opens a dispute after 2 and a half months for item not received
Hello, a buyer opened a dispute on 22/01/2024 for item not received, the item was shipped with PIEGO LIBRI ORDINARIO on 03/11/2023 (purchase date 01/11/2024) shipping method chosen by the user, among the shipping options REGISTERED shipping was also available, at the time of shipment I also sent the buyer a photo of the stamped envelope being mailed from the post office where the Poste Italiane postage label is clearly visible, showing the date and time of the shipment! How long after the shipping date can a buyer open a dispute for item not received? I would also like to point out that the dispute was filed at 1:30 a.m. on Sunday night... (which sounds a little strange to me) and since until now it had never happened to me that a PIEGO LIBRI ORDINARIO was not delivered after more than two months, I suspect that the buyer wants to take advantage of eBay's refund rules! Do you have any suggestions on this? Can a user open a dispute for item not received more than two and a half months after the shipment took place?
Is the photo of the stamped envelope being mailed from the post office, with the recipient's address, date, time and shipping office clearly visible, not valid as proof of shipment? And what can I do if the user chose the cheapest shipping method to save €3.50 difference?
Thanks in advance to anyone who will reply and be able to help me!

Mentore2 years agoHello,
it's always the same story, if YOU offer an UNtracked shipment, you are responsible for it... you can't pass the responsibility onto the buyer because they chose it!
A buyer can open a dispute on Paypal within 180 days and a chargeback within 13 months.
What can you do?
Refund them and that's it... after all, you don't have any proof of DELIVERY... proof of shipment is useless!
If you do nothing, Paypal will make the decision with the added costs charged to you, the penalty, namely €16 + VAT.
Kind regards.

OP2 years agoI understand, but I had also warned the buyer about the risks of that shipping method and he had said it was fine anyway... so besides providing proof that the shipment was made, what else can I do? I offered the PIEGO LIBRI ORDINARIO shipping option as a service the buyer can choose to use or not, if he was afraid of not receiving the item no one forced him, in fact he could simply have chosen RACCOMANDATA; so I’m not shifting any responsibility at all, on the contrary from my point of view the buyer should take HIS responsibility! Moreover, the dispute was opened on eBay, not on PayPal... do the timeframes for doing so match?

Mentore2 years agoI’m repeating myself, shipping is your risk, knowing eBay’s rules, you should have avoided untracked shipments... so the whole point that the buyer “should have” chosen another one, if you offer one that costs less, you know very well yourself what will be chosen... if it doesn’t arrive anyway, eBay refunds.
Of course, the dispute was received on eBay, but through the payment method the buyer used, because on eBay it was only possible to open it within 30 days from the presumed delivery date.
So, my advice is, don’t beat around the bush and refund voluntarily, after all, once again, you can’t prove delivery.
Kind regards.

OP2 years agoI understand, thanks for the advice.
Anyway, this ebay refund policy can only encourage "scams" by buyers who thus feel entitled to act dishonestly!
I am not a professional seller, I simply sell books that I have read and that I don't want to keep, mainly to buy new ones to read...
And personally I would never take advantage of this loophole in the refunds, especially when a seller shows me that they actually shipped it! Not only that, before opening any dispute (which I repeat I would not do if the seller gave me proof of the shipment!) I would ask the postman in my area or the destination post office for information about the shipment I am waiting for! Also because if I now issue the refund and, absurdly, the book packet arrives tomorrow, I doubt the buyer will bother to refund me again...
I do understand though that these are words in the wind, these days it is honest people who have to be careful and dishonesty seems to be protected!
Anyway, thanks again for the replies, I wish you a happy day

OP2 years agoGuys, I wanted to let you know that ebay closed the dispute in my favor! 🙂

Mentore2 years agoWell... but eBay is a strange world! 🤔

OP2 years agoIn fact... anyway, they found that the buyer never replied to my messages to resolve the issue and, above all, the 30 useful days for opening a dispute from the presumed delivery date had long since passed!

Mentore2 years agoAh... that’s why!
Best regards.

Mentore2 years agoYou didn’t understand the concept.
It’s not the buyer who has to choose whether or not to accept the risk of an untracked shipment, since the only one taking the risk is the seller.
As Sika already told you, proof of shipment is useless. You’d be better off refunding immediately.
