smartphone purchase, arrives with non-working camera
I bought a used mobile phone for €299 from a private seller.
In the description and photos it showed some small dents in the body, but the screen was ok: "Used item, light scratches on the top and bottom. Screen ok, back ok.
Fully working stylus. Battery life, all day."
No returns accepted.
Paid with PayPal, it arrives, it works fine, BUT the rear camera won’t focus!
So, apart from the photos, I can’t even use it with apps that require scanning a QR code or anything else, like bank withdrawals...
What’s more, you can see a small amount of glue sticking out from the outer edge of the camera glass... a sign that something had been done to the camera and he didn’t mention it...
Looking back at his listing photos, when you zoom in you can see the two glue spots on the glass...
I asked for an €80 partial refund (which is the cost of repairing the camera) or a return, since it’s very different from the description given and in fact unusable.
He hasn’t replied yet.
If he doesn’t accept, should I ask eBay to step in? (Then PayPal if needed?)
If he doesn’t pay, can PayPal do it for the €80?
In cases like this where the seller doesn’t accept returns, but misled in the description, can they still be forced to take it back?
If he had written it, I would have assessed the price more carefully, since it wasn’t €300 anymore but €380...
Thanks, bye

OP3 years agoSo, he accepted my request for €80 in the dispute.
But I went to the shop where they would repair it for further confirmation, and they told me that the rear glass shell had already been replaced, so it’s no longer original Samsung.
And so, since it’s not original, it’s weaker; they can’t guarantee it will hold up when they have to remove it, so if all goes well it’s €80, otherwise it’s €80 + €60 for a new shell! But he also told me that in the best-case scenario I’d only pay €15 (the shell won’t break and the camera only needed a cleaning)! So the price would be somewhere between €15-140€...
At this point I can’t accept the €80 without knowing what’s going to happen...
What should I propose? Could I propose that he pays the invoice at the end of the job, which could be €15-80-140€? If he agrees in the dispute messages, is it binding for him to pay me, even if I have to pay the shop first?
Or what should I do?
Thanks

OP3 years agoThanks a lot.
They just replied, saying that I should open the dispute so they can refund me...
In the dispute I put:
the item is defective
or
item does not match the description or the photos

Mentore3 years agoItem not as described, it doesn't match the description (since nowhere do you say there's a defect in the camera).

Mentore3 years agoHello,
if the item does not match the description, the seller is obliged to accept the return.
So open the correct procedure on eBay:
https://www.ebay.it/help/buying/returns-refunds/restituisci-un-oggetto-cambio-di-un-rimborso?id=4041&st=3&pos=2&query=Restituisci%20un%20oggetto%20in%20cambio%20di%20un%20rimborso&intent=reso&lucenceai=lucenceai&docId=HELP1134
The seller will be obliged to accept or offer you a partial refund,
If they do nothing, on the fourth day you can have eBay step in:
https://www.ebay.it/help/buying/returns-refunds/chiedi-ebay-di-intervenire-acquirenti?id=4701&st=3&pos=2&query=Chiedi%20a%20eBay%20di%20intervenire%20-%20acquirenti&intent=intervento&lucenceai=lucenceai&docId=HELP1382
Kind regards.
