Incorrect charge
Summary: The discussion, started by bestvendorsince2008, concerns an incorrect charge. cizeta1964 and marioelegio participated, but the details of their contributions were not provided.
Good morning, given that I have been an eBay seller since 2007/2008 with 100% positive feedback...to make a long story short...a buyer purchased an item from me with photos clearly visible in the listing...at his request I sent him more to make sure he was convinced whether or not to buy...after I sent additional photos, the buyer decided to purchase and, as usual, made the payment and I immediately shipped it. Once the package arrived, the customer told me he wanted to return it because, according to him, the boots were damaged (after I repeat having seen a dozen close-up photos of the item)...the listing clearly states "seller does not accept returns"...the customer opens a dispute requesting the return and a refund of the amount paid...eBay, without hearing reason and without even giving me an answer, accepts the customer's return and automatically charges my payment method the amount they say I should have given back...at this point I have still not received any return and every day I consistently get a notification from the bank saying that "there is an imminent charge from eBay" but that it was not processed due to lack of funds...now I ask myself...how can eBay demand the money back if it chose to violate its own rules? Returns not accepted is clearly written!! But the most outrageous thing is that eBay agreed to refund the customer without even having received the return!! I think I'll call the bank at this point to dispute this charge since it was done in an improper way, violating the very rules set by eBay!!

Mentore6 months ago.... indeed, in this case it is not even a rule of eBay, but an article of our civil code.
In the event of non-conformity, the buyer has the right to be refunded without any expense on their part (the return must be at the seller's expense).
The clause "returns not accepted" can only refer to the case where the buyer changes their mind, but it has no validity against a legal provision in the event of non-conformity.

If you've been on eBay for a long time you should know that, if the buyer believes the item is not as described, no returns not accepted clause will help.
You have to provide, within the time set by eBay, a return label at your own expense, otherwise eBay refunds the buyer - with your money - and exempts them from returning the item.
It's clearly written in the rules, eBay has not violated any of its rules and you accepted them when you listed your items.
