On September 26 I bought from a seller in the province of Bari (shop) two customized kids’ kits for a football team, for which returns were not предусмотрed, total price € 78. The seller gives me the tracking information and tells me about the delivery times, saying it would arrive between October 1 and 7. After several tracking attempts I find out that the items were shipped from China, something that was not indicated in the listing, and they were delivered to me on October 24, well beyond the estimated dates communicated by the seller. On November 14 I accidentally noticed that the two kits are counterfeit and I reported it to e-bay, attaching the photos and asking for compensation, pointing out that the listing did not allow for any possible return of the items. E-bay replies to me and on November 22 informs me of the removal of the listing for policy violation, without any mention of my refund request. At that point I contact e-bay support by phone explaining the situation, but without receiving any kind of support, and so on November 23 I open another report by email, explaining once again what happened, and I am told that I have to open a return request with the seller (despite the fact that I had reiterated that returns were not contemplated in the listing), which I do on November 24. The seller did not reply to me and I pointed this out to customer service, which replied denying me the refund because the seller did not accept the return (and thank goodness... it was written in the sales conditions) and that there is no e-bay protection because the return request was made beyond the 30 days provided (which is not true because I received the items on October 24 and I submitted the return request on November 24, moreover because of the delay in e-bay’s response in reviewing and then removing the listing). The worst thing is that the real problem is that the items come from China and are counterfeit, which is why e-bay itself removed the listing, but its customer service keeps making it a return issue, which I repeat is not possible according to the listing conditions. I want my 78 euros back because I was scammed.

OP8 months agoFrom October 24 to November 24 are exactly 30 days. In any case, from the start the announcement did not provide for a return. I received fake stuff, where is the protection?

Mentore8 months agoIt has already been explained to you that an unaccepted return can only refer to a change of mind on your part.
No seller can ever refuse a return in the event of goods not conforming to the order.
Obviously counterfeit goods cannot conform to the order.

Mentore9 months agoYou completely got the reason for requesting the return wrong.
The fact that a seller does not accept returns refers exclusively to your change of mind.
In the case of a return request for an item that does not match the listing, no seller can refuse it and the costs (of the return) are on their account.

By now the mistake you made no longer lets you proceed on eBay. Only if you paid by credit card, you can try asking for a chargeback from your card issuer.
eBay then removed the listing because it was an abusive dropshipper selling counterfeit goods.
