I purchased on 01/24/2025 "VHS/DVD - Samsung DVD-VR325 - Completely serviced" but it arrived with faults on the motherboard; after taking it to be repaired at my own expense in no fewer than 3 service centers, in the end, although they were able to carry out a repair on the motherboard, they found that both the VHS head, which is not replaceable because it is out of production, and the circuitry upstream of the HDMI connection were damaged.
I kept the seller fully updated - always through eBay chat - about the various problems, and when in the end I asked to return the video recorder to him and be refunded, he did not accept. Also in violation of what the Legal Guarantee explicitly states at EU level ( Product guarantees in the EU | Legal guarantee - Your Europe ).
I also wasn’t even able to submit an appeal to eBay against his decision, because his refusal automatically closed off that possibility too.

Mentore1 year agoYour intervention, besides being non-compliant with the rules of a public forum, makes little sense.
So, for the two reasons mentioned above, you were the one who decided to give up eBay support.
Finally, the legal warranty you invoke is due only from professional sellers for the protection of consumers, it cannot be applied to a private seller and in any case it expires when the product is opened by third parties.

your observations are, in general, correct. However, I have the impression that you did not read my post carefully, from which it can be seen that the item in question is used ("Totally overhauled" the seller states) and therefore I doubt that what you suggest in point 2 applies.
Regarding point 1., as I said, I made use of eBay’s return request tool, but the seller رفض it. eBay support then suggested that I contact the seller anyway, reminding them that beyond eBay’s rules, they also had to take the Legal Guarantee into account. Let’s say that eBay did not advise me well, because I agree that what you say is true.
Except for the fact that eBay itself, in point 2 of https://pages.ebay.it/diritti-acquistando-da-venditori-privati/
states clearly that there are protections even in sales between private individuals. But then you have to have the strength to enforce them.
And here I come to the point that you seem to completely ignore in your almost ex officio defense of the eBay system; if the system allows a scam - and it is undeniable that I was scammed - and is not able (or does not want) to get into the merits (and it could, because the entire negotiation and communications took place on the platform), then the system has a critical issue that should be addressed, for the benefit of the user community.
If you had been in my shoes, how would you have felt?

if you opened a return request and the seller rejected it, it’s because you opened it with the wrong reason, for example change of mind or wrong purchase, or after 30 days from delivery.
There are no other reasons.
So if you made a mistake, take responsibility for it and don’t dump it on others by always telling the same old joke that eBay is defending itself... eBay has rules, if they’re respected it helps you, and the people who answer always make that clear, but most of the time it doesn’t suit them.
