How can I cancel an order when the owner can no longer log in?

I bought an item from a man who says he can no longer access the profile from which I purchased it (of course he managed to contact me from another account), unfortunately the item for sale had also been listed by mistake by him, so I asked for the order to be canceled, the problem is that he cannot cancel because he has no way of logging into the profile, now my question is this, do I have to wait until the delivery date expires and I receive nothing to request a refund? Or since I’m already in contact with the seller and I’m sure nothing will be shipped, is there a faster way?
