Controversy over failure to deliver
Summary: The discussion concerns a dispute over a missed delivery, but the specific details of the discussion were not provided.
Hello,
As instructed by the seller, on 11 December I was supposed to receive an item ordered on 29 November, which in fact was not delivered to me.
The parcel was being held at the courier's branch because the address provided by the seller was incorrect/incomplete. We informed the seller of the situation and he told me that, after checking, the parcel had been released by him and sent back to the seller himself. I checked the tracking and in fact the parcel was returned to the sender. I then asked the seller for clarification, and he confirmed that the parcel had returned to their premises. At that point the seller asked me whether I preferred a new shipment or a refund. Given all the hassles, I asked for a refund. To make a long story short, now the seller is telling me that it is not his fault that it was not delivered and that eBay's guarantee has to respond.
eBay, I don't know on the basis of what information, closes the dispute I opened and tells me that I am not entitled to a refund.
I feel like I'm being taken for a ride and I'm asking if someone can help me. (PS we're talking about goods costing around €80). Thanks

Mentore1 year agoGood morning,
you are not entitled to a refund because the seller shipped it, and if the courier says the address is incomplete, that is your responsibility.
How can you be sure it was the seller who made the mistake?
Have you asked them for a copy of the waybill?
Have a nice day.

OP1 year agoWrong address, my responsibility? When ever…
The address the seller was supposed to indicate is the one I’m registered with on eBay…. I’ve made hundreds of purchases and the address has always been the same, and there have never been any problems. Besides, before making the payment I checked that all the details, including the address, were correct.
If you, as the seller, send a package and the address is filled in incorrectly by you, is it the buyer’s fault? That’s a new one for me……. I find your communication very questionable

Mentore1 year agoThe address the seller was supposed to ship to is the shipping address, NOT the billing address... they are two different addresses and they don’t necessarily have to be the same.
So you asked the seller for a copy of the waybill to dispute my "communication"?

OP1 year agoI’m not a lawyer and not even a judge, but I can assure you I know what ‘delivery address’ means.
I don’t intend to argue with you about my problem ..... I was looking for help and you’re just making me waste my time.
Let’s leave it at that.
Best regards

OP1 year agoPS
When you order on eBay, before payment the SHIPPING ADDRESS is highlighted, not the registration address.
I’m letting you know in case you didn’t know.

Mentore1 year agoOf course I know... maybe because I reminded you of it myself... right?
