Right of Withdrawal with Unfair Terms
I am about to buy a replacement part (an electronic board for an oven listed as compatible with my faulty original part), but I found this information about exercising the right of withdrawal. I’m wondering whether it’s possible to include such a clause?
"Information pursuant to Legislative Decree no. 185/99 - Purchases made on eBay, like all distance purchases by phone or correspondence since they take place outside commercial premises, are protected by Legislative Decree no. 185 of 22 May 1999, which provides consumers with the possibility of exercising the right of withdrawal. The consumer may exercise the right of withdrawal within 14 working days from receipt of the goods. This right consists of the option to return the purchased product to the supplier without any penalty, and the consequent refund of the purchase price, less shipping costs, which will in any case remain the responsibility of the customer. Please note that the right of withdrawal lapses if the replacement part purchased has been tested or if its packaging has been damaged."
