eBay refund and fees paid anyway item is left to buyer embezzlement
eBay decided to refund the buyer who broke the item himself, kept the fees, and left my item that I refunded, so it is mine, to the buyer. This is fraud and a criminal offense under Italian law for embezzlement, punishable by 3 years in prison and a fine of 10,000, but eBay says it’s okay like that, so thanks to eBay I paid eBay, paid the buyer, and I no longer have my high-value item

Mentore1 year agoIf you had followed eBay's instructions, you would have gotten the broken item back before issuing the refund.
Since you can't prove that it was the buyer who broke the item and since you didn't take care of the return (according to the rules of the civil code), you have no chance of getting anywhere with a report for embezzlement.

Mentore1 year agoObviously, that’s an assumption of yours that can’t be proven.
You were negligent in handling the return... that’s why the buyer now has the item and the refund.
You simply should have made sure how the return request worked... if you do nothing, eBay automatically sides with the buyer.

OP1 year agoIt’s not a matter of negligence, because the handling was correct; the problem lies in taking a situation for granted as if it were mandatory, and they are called in to intervene to decide in a consistent and fair way based on the actual facts, not by siding with a complaint even if it’s wrong, and the fact that someone asks for the truth and for the rules to be respected by them (eBay) is not a valid or legitimate reason to take other people’s things, because that’s what this is about; it doesn’t happen that when a thief steals, they’re allowed to keep the stolen goods and are even paid for being robbed... and then you pay them damages...
Anyway, it’s not that I did nothing: it is legitimate to present your side in a dispute, and the fact that a solution wasn’t reached does not mean that it wasn’t established how it worked

You also had several days to appeal eBay's decision, did you at least do that?
Anything you can blatantly prove can be mirrored to say that the item broke on your side before you shipped it. No one on any platform would ever accept your argument.

You didn’t handle the return properly... pointless complaining about it now.
It was your responsibility to provide the return label, it wasn’t eBay’s job!
