Refurbished appliance Without invoice
Hello, I bought a refurbished iron a couple of weeks ago. It arrived without a receipt or invoice. When I asked for it, the seller replied that it must have been sent to me by email. I said no and requested it again twice, leaving my email, and so far nothing... I ask eBay for assistance.. totally absent. What should I do?

Mentore11 months agoFor online sales there is no obligation to issue a receipt, and the invoice must be requested (from sellers who can issue it) at the time of purchase.
If you didn’t do it then, now you can’t ask for anything.

OP11 months agoHi, thanks for the reply. But objectively, if I buy a refurbished item, I have a one-year warranty as stated in the listing. By law, the manufacturer has to guarantee it, not the seller. But if the seller is the one taking the money..they have to issue a receipt or invoice at the time of payment. Without that, how am I supposed to have an official warranty? On other platforms I’ve always received an invoice for appliances I bought without ever asking the seller for anything. That’s what Italian law requires. Only in private sales is no receipt issued. PS, especially since the seller said they had sent it to me by email earlier...and it never arrived..

Mentore11 months agoI think you have no idea at all what our laws establish.
By law, whatever you buy must be guaranteed by the seller (EU law and therefore it only applies to professional sellers with their registered office in one of the EU countries). Art. 133 and following of Legislative Decree no. 206/2005.
What does the parent company have to do with it? How can the parent company certify a refurbished product from third parties?
If you are referring to Amazon, you are referring to a seller (who may decide to send an invoice to all of their buyers) and not to a platform (if instead you buy on the Amazon marketplace, you have to explicitly ask for the invoice).
In fact, the law regulating online commerce does not provide for the issuance of a receipt since all transactions are traceable.

OP11 months agoHi Mario, thanks. You're right. When I was referring to brand-new cases, I meant for a new item, not refurbished. I've always known that the company is liable for manufacturing defects for two years. For refurbished items, I know the seller is responsible..but I thought that to do so, the receipt or invoice would have to be sent automatically..without an explicit request.
