I’m reaching out to the community about a problem concerning a negative feedback sent for a purchase (I am a buyer). The matter concerns the very nature of feedback, which I had understood as the opinions of those who buy the goods being sold. Well, in my opinion, to have any credibility, I understood it as a free expression (if one were always supposed to give a positive opinion, it would just as well not be asked for). I had paid for the goods on April 24 and as of today there is no delivery estimate shown on the site (we are on May 7). In my feedback I concluded that the fault was mine for not having assessed the drawbacks well enough. Immediately the seller contacts me, ordering me to withdraw the feedback, calling me a spoiled child and threatening legal action. Question: is this normal? Another question: how can such behavior be reported to the site administrators? Thanks (I should note that I have completed around a hundred purchases and only in this case had I expressed a negative opinion, and in another a neutral one. I don’t think I’m a complainer)

No, that’s not quite how it is, and the feedback left so far clearly proves it.
It’s enough to open a dispute for item not received at the end of the days expected for delivery; what you assume, you can’t write in a public feedback.

Shipping had a delivery time of about ten days. So, considering the holidays, maybe you might not even have been able to open an eBay case for a refund request for an item not received.
The feedback left contains a prediction (as such, absolutely subjective) about the quality of an item you haven't even seen yet. So you cannot deny that it is a defamatory judgment against the seller (art 595 c2 of the penal code).
He will hardly take legal action for less than 100 euros, but that does not mean he would not have the right to do so.

OP2 years agoGood day, thanks again for what you wrote. I’m addressing you because you have shown a legal-technical knowledge that I did not have and do not have, for some advice. I paid for the goods on 24/4/24; today is 10/5/24 at 13:30 and on the website I still cannot find out when delivery is expected. As you will surely know, the website shows a request for feedback. taking into account that in the listing it was expressly written "returns not accepted". Until when do you think it is reasonable to wait for the item I paid for on 24 April? And furthermore (again appealing to your legal-technical knowledge), what kind of feedback would it be that I would leave. Thanks again, gianni

If the site you’re referring to is eBay, you’ll get real-time updates on the courier’s website or on 17track, if the seller has provided you with a tracking code.
The site instead shows a latest delivery date, and if nothing has arrived by the day after that date you can follow the procedure to be fully reimbursed.
The fact that the seller does not accept returns is irrelevant if the item is not as described, because by following the site’s procedures you can still be fully reimbursed, provided that you return the item in question.
After all this, I think there’s very little left for you to assume and/or presume, especially via feedback.

OP2 years agotoday is 19/5/2024; I paid on 24/4/24 (55 euros plus 19.99 shipping). No news on how and when I will receive the shoes I bought. Strange, but true. I wouldn't know what to assume and/or suppose. I appeal to the wisdom and familiarity shown in the replies: what can I do? Thanks. Maybe it won't be a feedback issue, but then what is it? Thanks

Mentore2 years agoAs already explained, it's a problem of impatience, of not reading the delivery terms, and of not reading how the marketplace works...
Obviously the "knowledge and familiarity shown in the reply" does not translate into "solve my problem for me or don't reply"... because no one has a magic wand!

I confess that I will never be able to come close to such abundance of arguments, such grace Thank you very much. By way of illustration, I summarize the terms of this enlightening affair: I paid on April 24, we are on May 20 and I do not know how or when I will receive the goods. What better example of impatience. If it weren't grotesque, it would be ridiculous

Mentore2 years agoYou've already been told in detail how to do it, put it into practice, in distance sales that's how it works, if the item doesn't arrive you follow the procedure and you get refunded, I imagine you've noticed that. Or is your problem wanting to leave feedback at all costs?

Reread the correct solution proposed by cizeta... if you still don’t get results with that, I repeat, nobody has a magic wand to solve your problem.
The most grotesque and above all ridiculous thing is to turn to the forum only when you have a problem without contributing anything and still expecting the solution, while also complaining about the answers received... users who ruin the marketplace and sellers with insane feedback that is of no use whatsoever.
Come on...
