Can you tell me how to do a return and refund if the seller has let 40 days pass?

I bought a fake silencer for the HDR 50 from treedeesolution, a German 3D printing site. The first one broke during assembly and the seller assured me he would send me a completely new one, printed with stronger plastic (that alone means he knew what he had sold.... after 40 days (40) today I received the "replacement" but it's only the slide and not the silencer... I should mention that I had sent plenty of photo evidence.... now obviously the return period has expired but on eBay you can see how long it took him to send me the part... and then I can't get eBay to help me... if eBay works this way, I think I'll just delete the app and since I'm a very good customer, I only expect shop owners to do their job. This happened to me with an outboard motor fuel tank and the seller replied after 3 days that the return period had expired. then eBay gave me assistance because it had seen that the email had reached the seller 1 or 2 weeks earlier... the plastic had broken at a welded point and an outboard motor is often on the boat.... I hope someone can explain what I can do. thanks
