THIS IS NOT A REQUEST BUT A WARNING...
After 23 years of faithful activity on eBay, I find myself forced to leave this platform. My experience, which I will share, could push many to do the same. I sold a NEW laser, I emphasize, NEW, in England. The buyer, after requesting assembly instructions via eBay messaging, took several days because of their inexperience. At the end of November, a dispute begins: the buyer complains that the item is not as described, showing a scratch on the profile and some marks on the plastic tool case. The lasers? Perfect.
I explained that those small damages were clearly due to assembly, but to no avail. I would like to point out that I had sold the item below cost as well. And how does it end? eBay sides with the buyer. My loss? 150 euros for shipping, plus 220 euros for the return. Not only did I lose over 400 euros in shipping costs, but now I have a devalued item that I can no longer sell as new.
After 23 years of honorable sales on eBay, I discovered that it only takes one dispute to lose everything. Sellers pay taxes and fees, eBay cashes in, and the seller is left with a bitter taste in their mouth. I am closing my account, disappointed and bitter about the treatment I received and the losses suffered.
Advice to readers: stay away from eBay. This is the advice of someone who contributed to their success for over two decades. I am a person with a disability, but I did not want to exploit this condition of mine to arouse pity, but rather to point out that, despite the challenges, I have always conducted my business with honesty and integrity.

OP2 years agoThe fact remains, and I say this for Italian sellers, that I lost 1400.00 euros. The seller who does "charity" has apparently pocketed 1400.00 euros, and the seller protection on eBay is worse than that of pimps for prostitutes... Really ABSURD to have to suffer in silence without anyone giving voice to the abuses suffered by sellers attacked by someone who calls himself one who dispenses advice but only to silence the injustices that so many suffer. The seller was reported for misappropriation. eBay Italy remains his accomplice, but what terms were there for providing the label? The dispute in Italy was still open, so why should I have had to pay for a label with an open dispute? So I could be robbed of the return shipping money too? eBay ITALY, in ITALIAN, should have told me to provide a label, since the funds were already frozen (another abuse). I'm filing the lawsuit, and I'm also publicizing this thing for the moral and psychological damages suffered. I am a person with a disability and I can't just silently endure injustices.

OP2 years agoOf course I understood where I went wrong, in trusting Ebay. Already done through lawyer Andrea Correale, who doesn’t think certain lines comply with e-commerce laws... If you need anything else let me know... I don’t understand why it bothers you so much...

The basic problem that your lawyer probably didn’t even understand is that eBay is not an ecommerce site but a marketplace governed by its own rules.

OP2 years agoOf course we understood that. Maybe you didn't understand. There was an evaluation from eBay open that I attached. Would you have refunded the shipping costs in this situation? But with a claim still under review, do you refund the shipping costs or wait for the case to be resolved? I know the rules very well and I know that without this OPEN dispute I would have refunded the shipping costs to the buyer. But if I had done that, what would be the point of this evaluation???? Give me a logical explanation, thanks.

Mentore2 years agoThe explanation is simple.
As long as the dispute is open, the seller can agree to take back the non-compliant item at their own expense (as governed by Civil Code art. 1490 and Legislative Decree 206/05 arts. 129 and 130), and in these cases eBay helps the seller get the item back, withholding the refund until it is returned.
When the deadlines of the eBay procedure expire, the dispute is closed and eBay decides whether or not to issue a refund. If it decides on the refund, it does not concern itself with the return. So you still have every right to get the return, but you have to handle it on your own by reporting the buyer, eBay, and whoever else you want.

OP2 years agoI just wanted to add that it really makes me angry to have to lose that money because Ebay UK was saying one thing and Ebay Italy another... It’s not fair that I have to make such a fuss because there are different communications to the buyer. Not because I’m a person with a disability, but seriously, it sends you into paranoia. I’VE NEVER gone through anything like this and think that whoever bought it, if it’s true, is a research doctor... I don’t get it, doesn’t he care about his reputation? Anyway, it’s a report for misappropriation that will be sent to the British police... I’m a private seller, it’s money I’ll never get back... Really ridiculous. But do you think that if there had been clarity I wouldn’t have sent the money for the shipping?... HMM...

I’m closing this discussion or else it’ll end "badly".I had attached that screenshot to explain that eBay Italy still hasn’t closed the dispute.My lawyer asked me for more documentation and has already sent a registered letter to the buyer, then we’ll proceed with criminal complaints, so it’s better to leave it here...Thanks again

I sent it via Paypal, to be "collaborative" as Ebay advises with the CHEATING buyer
80 pounds plus another 210.00 euros for the return. Will he answer me? To talk to Ebay, you have to tear your hair out. An automatic responder that doesn't even use AI... There, I could describe their automatic responder as: "in his own image and likeness"... One you tell one thing to and it responds about what it ate yesterday....
Are we kidding? They are paid with our HEAVY commissions. Instead of assisting us, what does Ebay do? It gives us an automatic responder on par with Alexa... GIVE ME A BREAK!!!
Take my advice, better Subito or similar sites, at least no one holds a gun to your head.

Are you sure? Sure, with Subito in the UK you definitely wouldn’t have sold... and today everyone puts a gun to your head if they get the chance.
It’s obvious you don’t hang around the community, otherwise you’d know that problems like yours come up almost daily, that the people who reply do so for free and voluntarily, while the people who ask, once they get the answer, disappear without saying thanks; those who instead don’t get the answer they want (and that agrees with them) disappear anyway, but not before insulting the person who replied politely and whose only “fault” was not giving the desired answer.
Clearly, you belong to the second category.

Anyone who regularly sells online has to take these episodes into account, it's inevitable, but not only on eBay, on all marketplaces there's always the chance of running into a less-than-honest buyer.
So it shouldn't even be considered a warning, but rather a possibility.

That for someone who makes a false claim they don't even bother to check the evidence you show?
What did I get lucky with? That I lost, besides the devaluation of the item, 400.00 euros in shipping?
NO, it's really a warning. This is behavior from EXTORTIONISTS, not an E-Commerce site.

Mentore2 years agoTry selling on other "marketplaces"; things certainly won't go any better.
The possibility is that you'll end up finding a "differently honest" buyer ... I already wrote that.
If you choose to sell also in non-EU countries, it's up to you to factor in losses like that... too easy when everything goes well, one "bad" sale and you want to ask for the account?
As an ad used to say: "do you like winning easy"!
