GPSR requirement for clothing items.
Hello,
I sell clothing items.
I can’t figure out whether I need to comply with the obligations related to the GPSR (in Europe and in Italy).
Clothing, etc. does not appear to be among the categories excluded from this requirement.
Since, in many cases, these are imported items (products from outside the EU) and the European importers/distributors have gone out of business, how should I proceed?
Can I list myself as the "responsible person" as a reseller?
It seems to me there is a lot of confusion about this...

Mentore1 year agoFrom what I understand, there’s no way around it for new items.
For used items we have many post-1993 products, so the manufacturer’s name and CE marking alone should be enough. For antiques the exemption applies only to the products listed in Annex IX and therefore almost only to those over 100 years old.

What happens if the manufacturer of my product no longer exists or has gone out of business?
There is no exemption for products from manufacturers that no longer exist. However, according to Article 51 of the GPSR, products first made available on the EU market before 13 December 2024 and compliant with the General Product Safety Directive (2001/95/EG) may continue to be sold without adding the information required by the GPSR to listings. This also applies if the manufacturer has gone out of business. For example, if you sell a compliant product that was made available in the EU before the specified date, you do not need to include GPSR-related information in your listing, such as the manufacturer details. You may still have information obligations under other regulations.
