I bought a vintage watch, sold as completely original and perfectly working (seller’s description). As soon as it arrived, I tested it and it wasn’t as described: non-original bracelet, internal movement running several minutes slow per hour, and the chronograph doesn’t work properly, it sticks, slips, etc... I contacted the seller right away, sending him videos showing the situation, and he claimed the watch was OK before he shipped it, that he’s a well-known, serious watchmaker, blah blah blah.... Since I wanted to keep the watch (otherwise I wouldn’t have bought it), we agreed that I would have it checked by a watch repair shop at my own expense, but if any damage was found, the seller would be responsible. Long story short, after discovering damage to an internal gear that cost 80% of the watch’s value, the deal fell through because he wasn’t even willing to meet me halfway on the expense.And that’s where the problem comes in, because I should have returned it according to eBay, but based on the seller’s fanciful promises I had it opened by a workshop, so on top of the damage there’s the insult.I’m asking whether it’s lawful, and without consequences, to lie about the condition of the item, even inviting me to close future transactions outside of eBay (a rule that should on its own already lead to action by eBay), in short, the list goes on....Well, in the end this seller, by taking advantage of the rules, ends up being in the right, so everyone should know that that’s fine... I’m not in a position to send the item back because I’d lose even more... and knowing the seller (not reliable at all, to say the least) I have a very strong doubt that he’ll refund me, using some excuse like the watch was opened or something similar...isn’t it so nice to be protected as a buyer.....
