Product not as described. Seller not responding. Return shipping costs are my responsibility. eBay is short-sighted
Hello, the negative feedback I felt compelled to leave the seller for the purchase is, I believe, eloquent of how things went. What surprises me are the shared and explicit eBay rules on returns, which force me to take responsibility for it despite the modest cost of the item purchased, so the seller can clearly take advantage of this by sending non-compliant products and then not responding to the buyer’s requests. I have noticed from recent feedback that I am not the only one who has experienced this situation. It seems to me that eBay used to be more attentive to such matters and especially to users. (the feedback: The decoder has the setting in Italian but then it does not change it and remains in a foreign language. I contacted the seller three times and they did not provide a solution, even though in their sales listing they assure support and despite the fact that on my third request I had proposed one myself. For the return I would have to pay almost € 10 in postage costs at my expense for an item I paid 21,89. I remain available for a solution, but nothing is done except disappearing, especially when contacted politely).

OP3 years agoSilka700, it could definitely be known when I left the negative feedback; all I’d have to do is file a complaint with the Postal Police, who can access the platform, as well as one with the ACGM: the first because, with your statements, you defamed me by making what I wrote out to be false, and this is a public platform — as stated in the notice when the page is opened — intended for exchanging advice, not “anything else” between Ebay users; the second to check whether a policy can be this contradictory and, at the same time, assess the seller’s conduct. The seller, after this legitimate complaint of mine here, wrote to me, implicitly acknowledging the issue, telling me that he is available to issue a refund, believe it or not, of 3 euros. I hope the seller will take my repeated proposal into consideration to find common ground.

Mentore3 years agoAs for return shipping costs, the policy is contradictory only for those who don't know how to read it. For everyone else, it's perfectly clear.
If the return procedure for a non-compliant item is used correctly, the refund must be full (with no return shipping cost). The buyer has the right to refuse partial refunds and request a full refund.

OP3 years agoSilka700, your insistence on your free access is telling: "1) The feedback was released not long ago, this morning (at 9:38) it wasn't there;". After mine there are 14 feedbacks and they are not all from today. Regards.

Mentore3 years agoThis doesn’t mean anything... and you can’t even see the issue date, it only shows "Last month" and for a seller with 400 or more transactions a month it’s completely normal to receive 14 or 15 feedbacks in a very short time.

I would like to point out that these situations are only the result of a mistaken interpretation or a failure to read ebay's rules... where does it say that if the item is not as described, ebay "forces" the buyer to bear the return shipping costs?
That is absolutely false, as it clearly states:

OP3 years agoSilka700, before replying, do your research: 1) I’m attaching the screenshot of the negative feedback that I (unfortunately, since I don’t enjoy doing it) had to leave; 2) if you don’t know what to say, don’t say it, because telling someone that what they write “is false” (even “absolutely”) is not lawful unless there is objective evidence to the contrary, not subjective interpretation, only Judges do that. Anyway, right in the link you attached it says: “The return shipping costs will be paid by the buyer or the seller, depending on the reason you are returning the item and depending on the seller's return rules”. The seller on this point has already stated that the costs are the buyer’s responsibility. Then eBay also adds “If you are returning an item because it is different from what was described in the listing or because it arrived damaged or defective, the return shipping costs are the seller's responsibility”. That seems to be my case, so regardless of the seller’s wishes the costs should be forcibly borne by the latter since the conditions for the above-mentioned return apply. Instead, further down in another paragraph, everything is called into question “The seller is required to send you the money to cover the return shipping costs in advance, since this cost is not covered by eBay Buyer Protection”. But imagine if he sends me the money. In short, everything and the opposite of everything. For 20 euros I’m not even going to try; I’ll keep the decoder in English, which works, but that does not mean I should keep quiet about the fact and the legitimate complaint. That’s all I had to say. If you need to send an item back to the seller, you can do so in several ways. Return shipping costs will be paid by the buyer or the seller, depending on the reason you are returning the item and depending on the seller's return rules.
It means:
In fact, it is immediately specified below:
If you are returning an item because it is different from what was described in the listing or because it arrived damaged or defective, return shipping costs are paid by the seller.
If you changed your mind about the purchase, and the seller's return rules stated in the listing say that return shipping costs for buyer's remorse are paid by the buyer, you are the one who has to pay for the return.
If the seller does not cooperate and does not want to cover the return costs (which, in the case of a professional seller, are required by the consumer code to be paid by the seller), just ask eBay to step in.

If the seller doesn’t cover the return shipping costs (by sending you a label) you can keep the item.
