Product not for sale because it is blocked
Something really unpleasant happened to me. In January 2022 I bought a used iPhone SE from the German seller. After good use, two days ago I found my phone blocked by a security routine (MDM) set by the previous owner of the phone, which I discovered was a German company that makes heavy machinery. I asked them to unlock the phone for me, not so much for the value of the phone itself but because, being blocked, I no longer have access to my personal data, as well as not being able to use it anymore. The company washed its hands of it, saying the product is out of warranty, but I’m not interested in having it repaired or in the item’s value itself; rather, I wanted to solve the loss of data caused by the block. I understand that the warranty has expired, but I believe the company could not sell a phone, especially if it was blocked by the corporate administrator. Do you think there is any legal or business action I could take? I’d be inclined to report them for commercial fraud. I know it still wouldn’t solve the problem, but I’d also like to point out, for other unsuspecting potential customers, that buying from them would mean dealing with a dishonest company. Any advice? Thanks

Mentore2 years agoHello,
from what you write, you used it for almost two years... so it wasn't blocked when you bought it!
Best regards.

OP2 years agoOf course it wasn’t, otherwise I would have returned the product immediately. That doesn’t change whether the seller knew about the lock or not. Probably, having picked it up as stock from a large German company, he didn’t carry out the proper checks to see whether the products were locked. When you sell a refurbished product, it’s assumed that you’ve done those checks! Now my problem isn’t the value of the item or the fact that the item is no longer usable. My problem is that the phone’s data is unrecoverable because it is completely locked and, above all, that I do not accept being commercially taken for a ride by the seller, who didn’t even try to help me, surely having contacts with the company from which he collected the goods and to which he could have asked to remove the lock from their Apple account. That’s all. Personally, I find it an unfair commercial practice, in addition to the damage it is causing me..

Mentore2 years agoIn Italy unfair commercial practices can be reported to AGCM, the problem is that the seller is German, but something similar should exist there too.

OP2 years agoIt would have been enough for me to be able to report it to Ebay so they could take action and it wouldn’t happen to other users of the platform, but unfortunately you can’t mention names and customer service doesn’t have a channel through which to make this report! So I thought I’d report it to the user community...

Mentore2 years agoTo report a seller, there’s the dedicated link:
https://www.ebay.it/help/buying/resolving-issues-sellers/segnala-un-problema-con-un-venditore?id=4022&st=3&pos=2&query=Segnala%20un%20problema%20con%20un%20venditore&intent=segnalare&lucenceai=lucenceai&docId=HELP1299
but it’s about a violation of eBay’s rules...
Kind regards.
