SHIPPED PRODUCT - THE BUYER SAYS THEY RECEIVED THE PACKAGE WITH PAPER AND WOOD INSIDE
Summary: The discussion concerns an issue with a shipment in which the buyer claims to have received a package containing only paper and wood instead of the expected product. The participants try to clarify the situation and discuss possible solutions to resolve the delivery problem.
Good morning, I’m writing to understand how to proceed, here’s the story:
- In September I managed to pre-order 2 Ps5 Bundle for Sony’s 30th anniversary for €1100, and I immediately sold the pre-orders on Ebay specifying that I would ship as soon as Sony delivered me the two Ps5s (release date 21/11/2024);
- During the wait I was always available for any questions for both buyers, one Italian and the other French;
- In early November the French buyer opens a dispute for item not received, the reason Ebay had told him to do so in order to extend the waiting and protection period (but I knew this, he had told me); clearly every week he suspended the dispute so that Ebay would not proceed with the refund;
- Last week Sony released the PS5s, shipping to those who had pre-ordered on 20/11/2024 via DHL and receiving the item the next day, i.e. 21/11/2024;
- On 22/11/2024 I proceeded to ship to both buyers after checking that everything inside was in order;
- Yesterday both buyers received the package, the Italian one went perfectly smoothly, he was really happy and also left me a super positive feedback, the French one instead sent me a photo saying that inside there are paper and wood;
- Now I don’t know what could have happened during the journey but on my side there has always been total transparency both in support and in letting them know what stage the order was at before the release date and also after when I shipped, unfortunately I didn’t take photos (probably the only flaw) also because the two buyers had 100% positive feedback, my question is what happens now? Has anyone been in the same situation? because from my side I did everything so that the shipment was fast and without any problem and I would never have dreamed of replacing the contents of the package, moreover shipping the item to one buyer and not to the other, aside from the fact that out of the two, as I also told him, it would have been more convenient for me to cancel the order and resell it for double rather than act in this way knowing that Ebay would have suspended my funds etc.... thank you in advance for the answers

OP1 year agoGood morning, about a year after the fact I'm giving you an update on what happened after this discussion of "fair and correct":
- I won the first appeal over a parcel not delivered because in fact the parcel had been delivered;
- Subsequently the French customer opened a second dispute for non-compliant parcel ("paper and wood"), after a tough fight having found delivery proof, weight never changed from when I shipped it to when he received the parcel, also leveraging the fact that on the same days another guy received the COMPLIANT parcel.
Also helped by the history I had pointed out about that buyer (a year earlier he scammed a German seller for a €1000 graphics card) Ebay sided with me and did not refund the buyer, as is right and proper;
- About 3 months after the second appeal the super buyer played his last card, that of the report through paypal of non-compliant item, clearly paypal sided with him but even in this case I appealed to Ebay and phone support told me that clearly it was yet another attempt at fraud and so they proceeded to refund me the amount that paypal had given him and that they would proceed to recover it from paypal (I don't know how it ended);
- Finally Ebay removed the buyer from the platform.
- Last thing, as I had already said, I as a private individual reported my EBay sales to my accountant for the tax return, because as I wrote at the time I am in total transparency about everything (although someone wasn't sure about it).
Thanks and goodbye

On eBay, presales with shipping made more than 40 days after purchase are prohibited: https://www.ebay.it/help/policies/listing-policies/regole-sulla-prevendita?id=4252&st=3&pos=1&query=Regole%20sulla%20prevendita&intent=prevendite&lucenceai=lucenceai&docId=HELP1252

Mentore1 year agoGood morning,
first of all, what you’re doing is not transparency... transparency is something else, and as a private seller selling items that you specifically bought to resell is a clear sign of operating without authorization... just as selling new items without specifying your VAT number is operating without authorization.
Returning to the specific case, if the buyer opens an official return request for an item that does not conform, you’ll have very few options to take, if not to take back the "paper and wood" at your own expense or directly issue a refund... if you do nothing, eBay will refund on your behalf with your money.
Have a good day.

OP1 year agoHi, by transparency I meant that I was always present during the waiting period and the period close to delivery and during shipping and delivery, and I know what I shipped, the item was as described, that’s all, I didn’t ask what is right or wrong about certain discussions.
What I wanted to know was exactly what can happen, because I know what I shipped and, as I already repeated in the message above, I shipped the same product to two people and I would have had no reason to send a fake package to one and not the other.
I also saw that in this buyer’s feedback, there is a story similar to mine from about a year ago where a German seller with, among other things, over 400 all-positive feedbacks had the same thing happen to him (the only negative feedback is precisely from this buyer), could Ebay also take this factor of repeat behavior into account? in fact it seemed quite strange to me especially because of the story.

Mentore1 year agoNo, eBay takes into account what happened between you, and if the buyer declares non-compliance, eBay will side with them regardless.
In any case, what is right or proper to sell on eBay should concern you, since you have amply exceeded the threshold of the DAC7 regulation limits, next year you will be reported to the Revenue Agency... which is why it should matter to you!
Kind regards.

OP1 year agoYeah, but I know these things. I just asked for information about what’s happening to me, that’s all, but so in any case the seller is always penalized in disputes?

Mentore1 year agoFor non-conforming item, yes.
Have a good day.

Mentore1 year agoFor distance sales, whatever the platform, the buyer is protected by the civil code and the consumer code. If the seller cannot prove the buyer's bad faith, they are forced to refund.
