RETURN OF NON-CONFORMING ITEM
Summary: lucacro bought a used smartphone described as 'like new' from a private seller, but found a serious issue with the display after the purchase. Despite a return request initially accepted by the seller, the seller then offered a partial refund of only 1 euro without any further explanation. lucacro is looking for advice on how to proceed, given their lack of experience with this kind of situation. The purchase was originally marked as 'returns not accepted'.
Hello, I bought a used smartphone from a private seller. The item was described as like new, perfect in every way.
As soon as it arrived I saw that it was indeed in excellent cosmetic condition and worked, so much so that I hastily gave positive feedback.
The next day, while I was setting it up, I noticed that it had a serious display problem: it was a strong yellow tone that could not be fixed in any way, not even after resetting it to factory settings.
I started asking the seller for information, and at first he said that it is normal for a 3-year-old phone, then he changed course and said he hadn't noticed.
From there on, more heated messages followed and he said that if I'm not happy with it I can open a dispute. The sale was marked as no returns accepted. Later I add a non-positive comment to the feedback.
The next day I take photos of the phone to prove the defect and I warn the seller that I would open a claim for return of the item as it does not match the description. I receive no response and I open a return request.
Soon I receive an email that the seller accepted the return, and that he should send me a shipping label.
Shortly after, however, he does not send a label, but instead a proposal for a partial refund of 1 euro. I give up and contact him asking for an explanation of the ridiculous offer and what he intended to do. We're talking about a sum of 230 euros. No response.
The phone was delivered to me 3 days ago, on July 8, and the return request was sent on July 10. I’m asking for advice on how to proceed, I’m not at all experienced with these kinds of procedures. Thanks. Luca
