Received package with missing phone inside
after buying a mobile phone (luckily at least a low-end one, 170 euros) I received the package but unfortunately, although the phone box was there, the seals were broken and the phone was missing inside.
the box itself was visually intact and in any case I wouldn’t have been able to sign with reservation since the courier had already left before reaching the gate.
I had to buy another one (same model) from another store and I also sent the invoice for the new purchase to the seller, as well as photographing the IMEI number on the box to ask for it to be blocked, so there can be no doubt about responsibility.
what really annoys me, though, is that the package was badly packed; in fact, it had only half a turn of tape over the opening side and anyone who had put their hands on it could easily have removed the tape, opened it, taken the phone and closed it back up. I sent the seller a video where this is clearly visible, and he replies that it’s packed that way on purpose so any tampering can be seen (and I absolutely don’t agree with that, in fact all of this could have been avoided with two more wraps of tape).
what do you recommend I do? it’s been a week and he says he opened a dispute with the courier, but on some things he’s really taking me for a ride, should I give it more time or open a dispute right away?
he’s a seller with 100% positive feedback on ebay but 3/5 stars on other channels (google, trustpilot which complain, among other things, about feedback deletions on ebay)

Mentore3 years agoSubmit a return and refund request for an item not as described (the empty box does not match the phone you ordered).
If the seller does not agree to refund you, ask ebay to step in.
