Request for perfume return
Hello guys, I’m Emanuele and I sell perfumes of my own property, accumulated over time, because with 3 children, I think the time has come to get rid of some small pleasures, to make a living from more important ones.
I’m selling my perfumes, found in the most hidden shops, thanks to my job that allows me to travel around Italy a bit and I can say I have received decent feedback from the most careful and empathetic users, showing that after many years and a lot of care, my products are still good and usable.
The problem I’d like to put to you, without boring you too much, arises with a used bottle of M7, which a Danish buyer received a week ago and now wants to return, because in his opinion it’s no good.
I know the perfume is good, because I know M7 well and I have already sold 4 of them between eBay and another platform and I have no problem taking the bottle back and refunding the money, but who protects the seller if this user is ripping me off (as they say in Rome?) How can I eventually prove that I was scammed? I’m afraid eBay isn’t particularly attentive in these situations and I wouldn’t want to end up with a product that isn’t mine or has been tampered with, by a zero-feedback user who, after 7 days, realized he doesn’t like the perfume. Sorry for the commas, periods and mismatched grammar but I’m very agitated. Thank you for the good advice you can give me

Mentore3 years agoHello,
it all depends on the claim they open for you...
If they open a return for change of mind, you can refuse it... but if they open a return for item not as described, you can't avoid accepting it, arrange the pickup at your own expense, and then refund it in full... whatever item gets returned to you.
Ebay can't carry out checks and so it will side with the buyer... beforehand... so if you don't want to risk losing money and the item by doing nothing and waiting for ebay's decision... it's better to minimize the damage by having it picked up at your own expense.
Best regards.

OP3 years agoThank you very much.
Very sad how eBay handles these situations, I think I’ll immediately abandon this platform to sell my hard-earned perfumes elsewhere, where there is greater oversight and fair impartiality is applied. Thanks again for the prompt response. Best regards to everyone

Mentore3 years agoThere are no other shores where it is applied....... at least not legally.
The obligation to accept a return for non-conformity is not an eBay invention, but an application of the Italian civil code on distance sales.

OP3 years agoCertainly, but who protects the seller if the buyer were to pull a fast one and send a bottle of Eurospin water instead of the perfume?
Online stores that accept returns, I think, are safeguarded by very strict regulations on the matter; what about us, about you? How do you protect yourselves?
Thanks

Best regards.

Mentore3 years agoOnline stores are regulated by the Consumer Code (Legislative Decree 206/05), which is even more skewed (in favor of the buyer) than the Civil Code. They are obliged to accept returns even in the case of a simple change of mind by the buyer, and they are even more exposed to possible scams.
