Refund not accepted
Hello, this is the first time something like this has happened to me. But if the recipient refuses the package and it is returned to the sender, is it normal that eBay does not accept the refund requested by the buyer?? I mean, the seller keeps the money and the goods that were sent back, and the buyer ends up with nothing?? eBay decides not to refund the buyer...is that normal??

Mentore3 years agoIf the buyer refuses the package, they give up ebay buyer protection.
So they may be entitled to a partial refund or a new shipment (at the buyer’s expense), but they’ll have to deal with the seller on their own.
If the seller doesn’t want to reach an agreement, the buyer could report them for embezzlement (the paid-for item belongs to the buyer and it’s their right to have it sent again at their own expense, or they can give up ownership in exchange for a partial refund).

OP3 years agoThank you very much for your reply. Unfortunately, the seller is very rude and arrogant, he has no manners when speaking...that is the impression I got. From the beginning I asked him for a refund (I refused the package because I had bought the bulbs for the car, which after I purchased these bulbs was then badly damaged in an accident, it is beyond repair). Clearly I refused the package because I no longer needed it..The seller, however, insisted that the package had been delivered.
I told him that yes, it was delivered, but back to the sender, the package had been sent back, everything is traceable. But the seller did not want to hear anything, and kept saying that I had received it. So I told him that I was asking eBay to intervene. On eBay I was only given the option to open a dispute the next day. Instead, the seller opened a case against me on the same day. Then I received communication from eBay saying that the seller had provided screenshots showing that the package had been delivered and the money was going to the seller. That is, they did not even look properly at who it was delivered to. I filed an appeal and they replied that they confirm to me that the package was sent back to the seller but since I refused the package eBay will not refund me. I can contact the seller and make an agreement with him. But I already know it is pointless.
It is truly absurd, I am left speechless. I mean, the consumer has no rights at all. But you are telling me that I can report him for embezzlement. Where and how do I do that? Thank you very much in advance and I apologize for such a long message, kind regards 🙏🙏

Mentore3 years agoTo exercise your right of withdrawal, you first had to take possession of the goods. Unfortunately, refusing the package was a very serious mistake. In distance sales, you must always receive the package and then, if necessary, return the goods.
Go to the police or the Carabinieri and report him.
