I'm being scammed by a buyer who made a false claim to eBay
I’m being scammed by a buyer who made a false claim. The buyer stated that the item didn’t work, but he never inserted the batteries, as he himself admitted. From his own photos you can clearly see that he received the item as described and shown in the listing photos, also confirmed by the WhatsApp messages he sent me. Is it possible that eBay didn’t compare the photos provided? Moreover, the buyer is a professional and seems to know how to use eBay’s rules to his advantage, with false and targeted statements.
In theory I should have time to appeal, but I don’t understand why I’m being prevented from adding evidence and proving the scam. For example, I purchased additional shipping insurance, but, moreover 1) despite the warning, the buyer did not sign the receipt with reservation, thus invalidating the insurance. 2)I sold the device with no possibility of return and, as reiterated, it was consistent with the description and the photos provided.
Where could I have gone wrong? How can I appeal? Why won’t eBay even accept the appeal? If the buyer keeps scamming eBay and me, do I need to contact a lawyer? Attached you will find the photo sent to me by the buyer showing that the machine is identical to the one shown in the listing.

Mentore2 years agoThere is no proof to confirm one argument or the other. No one will be able to determine, with certainty, which of you two is right.
This is one of the main features of all distance sales (on any platform): when the buyer disputes the goods as non-compliant, it’s not worth arguing back; you can only try to limit the damage by immediately offering a prepaid label to get the item back and refund.
If the buyer does not make procedural mistakes, objecting, appealing, or taking legal action only leads to higher costs.
