IPHONE 8 SCAM how should I proceed?
Good evening everyone, this is the first time I’ve written on this Forum, and I’d like your advice on how to proceed to resolve my situation. In August 2022 I bought an Iphone 8 from the seller with the following title "NEW! APPLE IPHONE 8 SMARTPHONE A1863 A1905 A1906 64GB 256GB 24-MONTH WARRANTY" with no mention of anything in the description. When the phone arrived at my house, it already raised some suspicions because it was not in its original Apple packaging but in a plain white box; anyway, I used the phone without paying attention to that detail. From the very beginning the phone had audio problems with the speaker because the volume, even at maximum, was very low until I decided to contact the seller and return the phone under warranty because it was definitely a factory defect. I entered the Iphone serial code on Apple’s official website to get assistance and the following message appears: "OUR RECORDS INDICATE THAT THE PRODUCT HAS ALREADY BEEN REPLACED. TO OBTAIN INFORMATION ABOUT WARRANTY COVERAGE AND SUPPORT, PROVIDE THE SERIAL NUMBER OF THE REPLACEMENT PRODUCT" The phone has practically already been replaced and it is a refurbished phone from the manufacturer. The phone is not new but rather an Iphone sent in for service, repaired and sold as new! I contacted Ebay, who tells me they cannot do anything and to contact the seller, I contact the seller who first asks me for €25 for shipping costs to "repair" the phone under warranty and now tells me that the speaker problem is due to dust inside, requesting €45 for the repair. How can I take action against this scammer?

By now you've gone your own way and it's too late to turn back.
Anyway, it was basically impossible to think it was new, since it was only produced in the 2017-2019 period and hasn't been officially sold for more than three years.

ebay can't help you, it's too late.
Keep in mind that the iPhone 8 was released in September 2017, discontinued in 2020... and now considered obsolete by the latest version of iOS... so unless it was leftover stock from a warehouse, it's hard to “believe” it was actually new!
Anyway, if you think you're in the right, you can check whether with Paypal you're still within the 180 days to open a claim on their site if you paid this way, or contact your bank for a chargeback; in this case you have 13 months.
