Scam on Smartphone Purchase from seller
Good morning, on December 7 of last year with PayPal transaction code: 9VN56431LH523223B we purchased a Huawei P30 Lite 128GB smartphone that the seller listed as "New" (Item Number: ***** and order 03-10899-92788), for an amount of 159 euros including 10 euros shipping costs. The following day, the seller contacted us via Ebay message, telling us that the P30 Lite ordered was not available and that he had just sent us a Huawei P40 with 128GB, and if that wasn’t okay, we could return it and wait for the arrival of the ordered P30 Lite. We asked the seller if anything needed to be added to the price and said that if it was new as stated for the P30 Lite, the P40 would have been fine too. When it arrived, we opened the package and, apart from the missing cables, the smartphone had the back cover peeled away around the buttons; when we turned it on, we noticed that the display had a faulty matrix with vertical lines and the touch screen was defective. The package received from the courier showed no damage. We contacted the seller listing what we had received and challenged the use of the word "new" in the listing. The seller asked us to return the P40 and sent us photos of a P30 Lite that had, by chance, become available. The photos were completely blurry and some were taken from such a distance that it was impossible to assess the condition of the smartphone. We asked him to send us photos with better definition and sharper focus; he sent us equally blurry photos. At that point we told the seller that in that case we were no longer interested in the purchase, also because, given the time that had passed, we had already arranged the phone replacement for our customer by buying it from another, more serious seller. The seller replied that the refund would be granted when the P40 arrived from us. So we immediately shipped the P40 with the postal tracking code that we attach. Meanwhile, we opened the refund procedure on Ebay, which replied that the procedure had been canceled because it was indicated as a return procedure and the seller did not accept returns. The package had been returned to the seller as requested and was on its way to the address provided by the same seller. Ebay wrote to us that we could open an appeal procedure, which was rejected the day after submission. We tried to contact the seller, who is currently unreachable and has not responded to us anymore. The Huawei P30 Lite appears to have been relisted on Ebay. We tried to contact Ebay customer service at 800175052 but it is impossible to speak to anyone. I believe that Ebay evaluated our purchase badly and very superficially; I also believe that the seller very easily made 159€. We will file a report for online fraud with the Carabinieri, who are the only certain authority to turn to. We have been registered on Ebay for about 17 years and have never had any problems, or if there was a small problem, we always resolved it with the respective sellers. At this point, I think I will try to avoid buying on Ebay given the total lack of interest in listening to those who buy and pay correctly on their site. Avoid the seller ****, in Italy we would say it’s a real dump..! Terrible and fraudulent..!

Mentore2 years agoLet's start with the mistake and with what the correct procedure would have been:
Return and refund request for an item not as described (rather than a return for change of mind), the seller could not have opposed this procedure (even if he stated that he did not accept returns).

So by entering the wrong reason, you also lose the possibility of requesting a refund on the return (since it was an unauthorized return). The same fate for the appeal, since nothing new was added compared to the incorrect procedure.
What could be done now is a dispute on the payment method, paying maximum attention not to get the reason wrong. You need to specify that the item was returned because it was not as ordered.
If you paid with paypal, you can open a dispute on the paypal website.
If you paid by credit card, you can ask your bank to help you make a chargeback.

The original message is included as an attachment, to open it click on the file "postacert.eml" (in webmail or in some email clients the attachment may have the original message subject as its name).
The attachment daticert.xml contains service information about the transmission

Mentore2 years agoEbay doesn't have a certified email address in Italy, so I don't know who you could have sent it to, but I doubt it has any value.
