Private account sales limit
Summary: The discussion regarding the topic of account sales limits remained silent as none of the participants added any content beyond their initial posts and responses.
I surpassed the limit of 30 items sold quite a while ago.
What happens now next year, will I receive a fine or can I save myself by getting a VAT number now.
Opening a VAT number will have an effect on my job, for illnesses etc...

·1 year agoHello, sorry, within how much time would Ebay send the report to the tax authorities?! As soon as you exceed the threshold of €2000 or 30 transactions?! Does the report go out immediately or does some time pass?! Do you know?! Kindly thanks.

·11 months agoI found them automatically in my tax drawer!... The accountant said, then, that they go under OTHER INCOME and are taxed at my IRPEF rate! 35%! I had sold old inherited objects, books, encyclopedias, photographic lenses, etc. that no one ever would take in secondhand shops... But around Europe there are people who appreciated them... more than 4,000 euros and the accountant taxed them all for me, not just the part over €2,000! So 35% of 4,000 euros is €1,400 sucked up in the 730. It’s to make you want to shoot yourself. If anything, it’s also anti-ecological because lots of objects will end up in landfill. So I have to wait until 2026 to be able to sell again... And meanwhile they take up space. Another matter: if a woman sells little things she no longer uses, bags, I don’t know, damn plates, glasses, Thun figurines that some poor soul gave her... 30 pieces are very few... Also, for example, a dependent daughter has a tax code and is merged into the family head. In practice, my daughter will never be able to experience the thrill of selling some unused item of hers, school books, etc.

·11 months agoOne more reason not to sell above the thresholds on eBay or on other marketplaces that send this data.
Items that can be sold with hand-to-hand exchange and cash are listed on those types of marketplaces that allow it.
In 2024 it happened that eBay counted total sales for each account, apart from any other accounts registered to the same seller.
Account A that sells for 1800 euros and 28 sales (not reported)
Account B that sells for 1500 euros and 29 sales (not reported)
Account C that sells for 1900 euros and 25 sales (not reported)
And so on.
So if these are your personal items not specifically bought for resale, I would say it's a matter of setting up sales strategies to protect yourself.
Best regards.

·11 months agoI’m afraid that with the latest “clarification” from the tax agency, this strategy is useless...
As regards identifying the seller, the Revenue Agency notes that the expression “registered on the platform” is intended to include all cases in which the seller’s data using the platform are in some way acquired by the platform, so that they can subsequently be communicated.
It follows that cases also matter where the user has not signed up to the platform by creating a specific account or profile, but has entered into a contractual relationship with the platform operator. Moreover, the term “registered” must be interpreted broadly and includes cases where a user has created a profile or account on the platform as well as cases where the same user has entered into a contractual relationship with the operator of the platform itself.
If the check is by tax code, all accounts somehow linked are added together.

·11 months agoThis was discussed at the end of 2024 when eBay had sent the reports, in a thread on DAC7
And I had already pointed out this BUG on the platform, which other sellers had also noticed.
If in 2024 the account did not exceed the thresholds, it was not reported.
Each account was its own separate case.
I had the first account with about 1800 euros in sales and over 30 listings sold, which was reported.
The second account, however, was not because it was below the maximum threshold limit.
If added together, my two accounts with the same tax code would also have exceeded the 2000 euro threshold.
This was the situation in 2024; for 2025 we’ll see.
Best regards

·11 months agoWhat do you know?
I just copy-pasted the latest interpretive circular from our Revenue Agency on the definition of seller.
Then, since eBay EU is German, we’d need to understand how their corresponding agency interprets it.

·1 year agoIf you’re under 30,000 euros in employment income and you don’t have any other disqualifying conditions, you can open a VAT number as a flat-rate taxpayer, so you won’t have VAT to pay, in 2025 you file a return for individuals (2024 income tax return) and report the receipts in LM it costs you little (of course the VAT number isn’t the only requirement, SCIA for starting the business with the municipality and registration with the c.c.i.a.a.a), if instead you don’t have employment income things get more complicated because in addition to taxes you have the INPS minimum contribution (around 4,000 euros a year).
If they were to call you in, it’s true that you opened the position late, but you did pay the taxes.
Talk to a professional in the field.

·1 year agoOpening a VAT number in Italy today means that you’ll become a partner of the State; I advise you to find yourself a salaried job and stay calm with the VAT number; there will be plenty of sleepless nights...

·2 years agoThe type of goods you were dealing in would have required opening a VAT number before the first sale. This is not about the limits of DAC7, but about rules that have existed for decades.
DAC7 will only oblige ebay to report you to the tax authorities.
Talk to your accountant and see what they advise you.

·2 years agoConsidering that you have sold almost exclusively "new" items and you have certainly also exceeded the €2000 threshold, I would say that you won't receive any immediate fine, but your name (and your tax code....) will be reported by eBay to the AdE, which next year will decide what to do.
If it decides to take action against you, it will carry out a tax assessment and then impose an appropriate penalty for failure to declare this income.
Open a VAT number?
Talk to an accountant and weigh the pros and cons: if you already have a salaried job, it's extra income that adds up and is taxed further....
