Good evening, I’m having problems with an English user. I sent this package (a vinyl record), which was delivered in front of the buyer’s door (without telling the courier to do so) and then disappeared. I contacted UPS right away and the buyer opened a dispute (eBay sided with me and closed it). Now the buyer is even threatening legal action if I don’t refund him. How should I handle this? Who is right and who is wrong? Of course I have all the proof of preparing the package and delivery. Thank you very much

·5 months agoGenerally, UPS takes a photo of where it leaves the package, so you could request it.
That said, UPS (like DHL and others) can also do signed, in-person delivery, of course for an extra fee on standard shipments (it’s included with express ones, though).
Another “small” obstacle comes from the “on-demand” service, where the recipient can choose how and where to have the package left, regardless of whether they’re there or not.
And, still with standard shipments, this option can’t be disabled by the sender (the sender, I should note, if the shipment was purchased through a broker, is the broker itself and not the pick-up point shown on the label).

OP5 months agoI have the UPS delivery photo, the buyer says they didn’t find anything at their door and has filed a report with the local police. I’m waiting for a response from UPS (they almost certainly won’t refund the full amount) but as already said, the eBay dispute was also closed in my favor because the package was indeed delivered to the address (even if with a negative outcome). Does the buyer still have the right to request a refund?

·5 months agoThe package for UPS was delivered successfully, which is why ebay found in your favor.
Nothing is final yet, between the appeal and payment methods, but if you win the appeal, after that you should be protected by ebay seller protection.

OP5 months agoI figured they'd ruled in my favor for that, what would the appeal consist of? Thanks

·5 months agoThe buyer can appeal the eBay decision.

If eBay rules in your favor even on appeal, then it will protect you in case the buyer files a chargeback with the credit card, that is, if the buyer manages to reverse the payment, eBay will cover the loss.

OP5 months agoSo let’s say the legal action threats they’re talking about are just empty words? Or can they actually follow through on them? Honestly, this is the first time something like this has happened to me 😅 I even contacted eBay, let’s see what they say. In the meantime, thanks a lot

·5 months agoIn principle, it is always possible to face a complaint for embezzlement (taking the money without giving any goods in return). A complaint does not mean that they will then side with him; it is quite likely that the opposite will happen.
But legal action has a cost, especially to report a person who lives in another state. If it wasn't a record worth thousands of euros, I'd say you can relax.
