Possible theft and package replacement
Hello everyone,
I’d need some advice, since I’ve never been in a situation like this. On Tuesday I opened a package, delivered to me the day before, expecting to find the Game Boy I had ordered, but instead I found a box set of comics. I immediately contacted the seller, saying there had been a mistake and that the wrong item had been sent to me, attaching photos of the item and the package, with the postal slip clearly visible. The seller replied rather sharply, asking me if I was joking, saying he doesn’t scam people (I never said it was a scam, I had written that there had been a mistake, but oh well), that he doesn’t own those comics and finally warning me not to “try any funny business.” For the record, the seller has around a hundred positive reviews and not a single negative one, so I had no reason to doubt his good faith. I replied as calmly as possible that I would never joke about something like this, but then I noticed that the declared weight on the slip is half a kilo (compatible with a Game Boy), while the weight of the comics box set is over two kilos. I think there was probably a switch before delivery, however the tape sealing the package was intact. The package is a white cardboard box with the “SDA PosteItaliane” logo printed on it, so I thought he might have packed the item directly at the post office using a box provided by the office itself. I pointed this out to the seller, saying that the right item had definitely been sent based on the weight, so I asked him whether the postal worker had sealed the package in front of him. He replied that he closes the packages at home and that the mail carrier did the weighing and everything else in front of him, then he ended by saying that once the package has been sent it’s no longer his problem, and that I should go ask at the post office. Maybe the seller, for his part, thought I was trying to rip him off, so I understand that, even if I remain upset by the lack of courtesy and involvement he showed. As a last attempt I try asking him whether he recognizes the package and the black tape used to seal it, so as to get more information. He tells me he recognizes neither the package nor the tape, says he seals packages completely with brown packing tape, covering the entire surface to keep them from getting wet, and he also sends me a photo (of another packaged parcel he had at home, probably) as an example. Then he repeats that I should go to the post office, that there’s nothing he can do, that he had never had anything like this happen to him, and he ends with a “good evening.” Now I’m in this situation: most likely the original package was stolen by a postal worker or by someone with access to postal materials, the postal slip was taken out of the outer plastic sleeve, and a brand-new package was assembled, with a new slip holder (since they’re impossible to peel off and stick back on) and a new tracking label was printed and attached to the sleeve (which shows a print date of October 5, while the package was sent on October 1). Is there any hope of at least getting the money back? In any case, this was a package sent by ordinary mail (there were no other methods offered by the seller), so I don’t know how much filing a complaint with the post office would help.
Thanks a lot and sorry for the wall of text

·1 year ago……. You will get the refund and it will be him, as the buyer, who has to deal with the post office.

OP1 year agoHi,
if you’re also telling me to do the return, okay, now I’m more convinced. Thanks for the reply

·1 year agoFrom your side, do you have:
The bill of lading with the correct seller and recipient?
- The tracking number recorded by the seller on eBay and the package correctly delivered?
Good: since the seller claims that "once the goods are delivered, it's the carrier's 'problem'", make him change his mind by opening a dispute for "item not as described".
He'll be forced (by eBay, not by you...) to provide you with a return label and you can re-pack the comics and send them back to him.

OP1 year agoHi,
thanks for the reply, I had actually thought about opening that kind of dispute, but since the "non-compliant item" is the fault of an unknown third party, I wasn't sure if that was the usual procedure. I tried searching the help section to see if there was any info about it, but I didn't find much, so I don't know according to the rules whose problem it is to deal with in this case 😅 They should add a section for "shady carriers" 😆
