Dispute + appeal of eBay's decision for item not received
Summary: gaikingdrago started a discussion regarding a dispute and an appeal of eBay's decision for an item not received.
Good morning everyone.
I’d like to hear your thoughts about what happened to me.
On February 23 I placed an order on eBay for two stickers (cost, including shipping, about 27 EUR) that never arrived.
So last week I opened a dispute with the seller, who updated the order information by entering a Posta 1 Pro tracking code, according to which the envelope was delivered on March 19 at 10:49 (https://www.poste.it/cerca/#/risultati-spedizioni/2IMA0057708901) without any other information about which post office handled it and then delivered it.
Since I was sure I hadn’t received it, I then went to my post office, where they gave me a printout obtained with the internal "Cerca traccia" function, which shows that the letter was delivered on that date and at that time by the mail carrier of the "MILANO REC BAGGIO" post office, which is absolutely not mine and is on the other side of the city from where I live: I live in the Viale Monza area of Milan, and my post office and mail-handling office is "MILANO 67 / C.P.D. MILANO PRECOTTO".
In practice my post office, as the manager of the postmen also verbally confirmed to me, never received or handled that correspondence.
But eBay ruled in the seller’s favor, who, moreover, also called me a "morta di fame" just because I kept insisting that he provide some other proof. I had asked the seller for a photo of my envelope showing the label with the Posta 1 Pro code, but he never provided it. The only information he limited himself to giving, by updating the information regarding my order after I opened my dispute, was precisely that tracking code.
I then appealed eBay’s decision, also attaching the photo of the "cerca traccia" printout I received from the post office, explaining to them that "MILANO REC BAGGIO" is not the office that handles my mail, showing them the addresses of the two post offices and their location in Milan, and also suggesting the possibility that the seller had provided a code from another shipment of his destined for Milan but for another person (someone living in the Baggio area, in fact).
Tomorrow I also wanted to go back to my post office, asking them to perform and print the "Cerca traccia" search for three eBay shipments regularly received, in order to prove to eBay that for those shipments the function indicated the "MILANO 67 / C.P.D. MILANO PRECOTTO" post office and not "MILANO REC BAGGIO" as the post office/mail carrier that handled my delivery.
Nothing: today eBay also rejected my appeal, because for them a proof of delivery without specifying to whom and where is enough.
According to them, the fault was with the post office, which must have delivered my envelope to the wrong person, and I should file a report with Poste Italiane for incorrect delivery.
But is it possible that eBay doesn’t consider the possibility that a seller could be a scammer (maybe that’s not the case for me, maybe it is) and that this person—having in fact never sent me anything—deliberately provided a code from another shipment of theirs, maybe for items not sold on eBay, regularly delivered in Milan but addressed to someone else?
I want to manage to prove that that letter was not addressed to me, even if I have to go all the way to the Baggio post office, and if I succeed I’ll report the seller for fraud!
Can you give me some advice? What do you think? Has anything similar ever happened to you?
Thanks in advance to anyone who wants to help me.
Best regards,
Ada
