Insults and feedback
Summary: The discussion titled "insults and feedback" involves interactions between several participants, but no specific content is provided in the given record.
Hello,
I’ve been on eBay forever (does anyone remember iBazar?).
In about 26 years, I’d never had anything like this happen to me.
I buy an item on Friday night, and because of personal issues, very early Monday morning I ask to cancel the transaction.
The seller starts bombarding me with messages and even insulting me for having very politely asked to cancel the order.
I report it to eBay; for them it’s okay for a seller to insult a buyer, I file a complaint, still all okay for them, they told me that if I want, I can file a report.
In the end, the order was canceled, and strangely on the
app I have the option to leave feedback for the seller. Obviously the seller deserves negative feedback, not for the item, but for the behavior.
If I attach a screenshot of the chat where he insults me, is there a chance that paradoxically Ebay will sanction me? can I do it?
I would, because I’m sure he’d call me a liar or insult me further.

·1 year agoquestion: you've been on Ebay for 26 years, never read the rules?
anyway, in short: you asked for the cancellation, the seller granted it to you (even though he wasn't obliged to do so), what you said to each other stayed between you in your messages..... giving a public negative for a transaction that was never completed could honestly be taken very badly by a seller who might even take legal action (obviously only if it were worth it to him....., so very likely he'd just let it go...) or ask eBay for a correction; in any case it is up to the seller to report the buyer's behavior to eBay....
Side note: I remember iBazar very well.... but those were different times.....

OP1 year agoI would be very happy if the seller were to take legal action, because the minimum I would be asked for,
would be the conversations and I assure you that it would not be at all in his interest for them to end up before a judge.
Anyway, I take the advice and forget what happened.

·1 year agoJust so you know, on eBay the seller and the buyer do not complete a sale directly.
Any potentially defamatory feedback is removed by eBay if reported.
If things are done properly, it never even gets to court.
It follows that if you do not complete a sale (by your own free choice) you cannot leave any negative feedback since it was you who asked to cancel the sale.
What would you want to leave negative feedback on?
Negative feedback is left on the sale and NOT on personal judgments about the seller.
Personal judgments in feedback are not accepted by the rules.
Take a look here:

OP1 year agoSorry, but it’s not as you say.
From the link you posted:
"Evaluate aspects of the transaction such as the punctuality of delivery, the accuracy of the item description, shipping costs, and the communication with the seller".
"Communication with the Seller," I assure you that if a seller insults me during the transaction, I definitely have the right to evaluate the communication with the seller.
Then, quoting the point: "If you decide to leave a negative feedback anyway, make sure it is objective, based on facts, and only related to the transaction."
I’m not judging the seller for their football fandom, but for the communication during the transaction.
Last thing, it seems to me that I’m the one at fault here; I don’t want to get into your opinions, which I respect, but it seems absurd to me that someone who insults outright because he’s angry about not having sold an item is being justified.
Thanks anyway for the suggestions 🙂

·1 year agoYOU HAVE NOT COMPLETED (carried through, finished, ended) ANY PURCHASE EXPERIENCE WITH THIS SELLER.
Feedback is left on completed purchases or on purchases canceled by the seller.
If the buyer decides to cancel a purchase, they cannot leave feedback EVEN if the seller replies to them in a rude tone.
If you leave feedback for an incomplete sale (at your explicit request), ebay will remove it.

·1 year agosmall detail : as said , the messaging remains between you and NOT known to third parties : the negative feedback instead is visible to everyone ( or anyway to third parties) since it is public ...... therefore , on a legal level, much more dangerous in case the seller wants to pursue legal action...... ( which anyway , as said, he will most likely never pursue since it would be uneconomical...... ) ;
so , to sum up and considering that the transaction was in any case canceled , perhaps the wisest decision ( as you also said, since you accept the advice ) is not to leave feedback , also because it will most likely be removed by Ebay ( either automatically or at the seller's request )
numismant_it
OP1 year agosure, I won't give any feedback 🙂

·1 year agoYou couldn't anyway because no purchase was completed.

·1 year agoHello,
honestly I can’t get my head around these positions...
The rules are clear:
https://www.ebay.it/help/buying/buyers-can-cancel-order/che-modo-gli-acquirenti-possono-annullare-un-ordine?id=4004&st=3&pos=1&query=In%20che%20modo%20gli%20acquirenti%20possono%20annullare%20un%20ordine&intent=annulla&lucenceai=lucenceai&docId=HELP1019#:~:text=Se%20hai%20cambiato%20idea%20su%20un%20acquisto%2C%20puoi%20inviare%20una%20richiesta%20di%20annullamento%20dell%27ordine.%20Il%20venditore%20pu%C3%B2%20accettare%20o%20rifiutare%20la%20richiesta%20di%20annullamento.
Had a change of heart? Take responsibility for it.
Did the seller insult you? Let it go, you probably caused them both financial damage and a waste of time.
If the seller deserves negative feedback, so would you, for “playing around” on eBay, whatever problem you may have had.
Have a nice Sunday.
numismant_it
OP1 year agoI accept the advice.
Comparing the right of withdrawal (it's a right guaranteed by law, not a whim),
to wanting to "play" is really not the best.
In my opinion, NOTHING authorizes a seller to insult a buyer and vice versa.
Anyway, thanks for the advice.

·1 year agoYOU DIDN'T UNDERSTAND....... on eBay when you pay for an item if you want to cancel the sale you have to contact the seller and ASK HIM politely and courteously if he can cancel the purchase for you.
The seller (as many do) can quite happily IGNORE your request and send you the goods.
After that you can exercise the RIGHT OF WITHDRAWAL (if it is a professional seller) paying the return shipping at your own expense.
If it is a private seller, your right of withdrawal may be denied (at the discretion of the private seller).
numismant_it
OP1 year agoI mean, I saved the professional seller from a wasted shipment and got insulted for it; imagine if I had had it packed, shipped, and then had to handle the return.
I’ll say it again: politeness is NOT optional.
heavenwelkin
·1 year agoAre you saying that the seller had no reason to behave rudely / disrespectfully toward you, but on the contrary should have thanked you because you saved them the return ?
Did I understand that right ?
sika700
·1 year agoToo bad the right of withdrawal can only be used if you receive the item... if the seller accepts returns, of course...
Enjoy the rest of your day.

·1 year agoHi numismant_it
I see that you’re also a seller; honestly, I’d let it go because, according to the current regulations, a seller is not obliged to cancel an order that has already been paid for.
Since you had paid on Friday, maybe the seller had already prepared and packed the item, so maybe they reacted badly (certainly the wrong reaction, but there were reasons behind it).
The seller will also have to pay a commission of 0.35 euro for your change of heart.
In my opinion, it’s already fine as it is, without further penalizing the seller.
marioelegio
·1 year agoYou could simply write that you asked to cancel the order and that, instead of replying to you, the seller insulted you. Without judging the seller’s behavior.
Probably the seller will ask for the feedback to be removed, since there was no payment.
