Claim for Non-Received Item
Summary: The discussion is about a claim related to an item not received. flaviocreations and heavenwelkin exchange messages, addressing the issue in depth, but the specific content is not provided. In addition, emme.elle.36 participates and there is a response from heavenwelkin. The conversation seems focused on clarifying and resolving the matter mentioned.
Good evening,
I wanted to briefly tell you what just happened to me, I’ll be very brief.
Today, January 19, a case was opened against me for item not received,
regarding a postcard sale made on OCTOBER 14, more than 3 months ago.
As far as I know, a claim for item not received can be filed within 30 days
from the expected delivery date, so automatically I should be in the right and this claim
should go nowhere. I should note that the buyer is also in Italy.
On top of that, icing on the cake, 3 days after I shipped it, so in mid-October
the buyer even WRITES me a positive review, literally 'All ok'.
Do you think anything can happen and the buyer can do anything else, or is the matter 100%
closed and nothing will happen? I, very honestly, don't think he's telling the truth.
Thanks in advance to anyone who can give me an opinion, maybe because they found themselves in my same situation.
Have a nice Sunday,
Flavio

Know this, everyone ... that the 30 days are a complete load of crap!
I had proof of it today myself ...
Item sold on November 14, 2025 ... shipped to England ... this guy asks me not to declare or insure for high amounts ..... ok.... I ship--
This guy doesn't get in touch ... until February 12 ... and ... surprise ... HE CAN OPEN A DISPUTE FOR ITEM NOT RECEIVED ... !
Yes ... after almost 90 days ....
Our / your dear ebay ... tells you that it's at most 30 days BUT IT'S NOT LIKE THAT!
Do you think ebay exposes these rules and enforces them? do you think ebay's system can't allow a buyer to open a dispute for item not received ???
NEIN !!! it's not like that .... officially they tell you that story! AND EbaY is the first not to make them respect it, especially with partners like PayPal ... who crush ebay and its rules!
BUT .... if the buyer paid with PayPal for example ...and the tracking doesn't clearly show ITEM DELIVERED (it happens sometimes) . ... you're screwed .... the buyer can open ITEM NOT RECEIVED even 90 days later ... and you'll lose the money ... even if you appeal!
Ebay tells you a bunch of bullshit with the 30-day story....
BULLSHIT !!!!!!!! I hope it doesn't happen to you too .... but sellers are NOT protected
In a dispute between ebay and paypal ... DON'T WORRY ... PAYPAL WINS ... AND EBAY SCREWS YOU OUT OF YOUR MONEY

·5 months agoGiven that if the buyer does not receive the item, they must be refunded.
A serious seller should refund the buyer if problems arise from the tracking.
It's certainly interesting to understand whether, in the case of the 30 days, ebay actually DOES NOT FOLLOW ITS OWN RULES.
It happened to me that it didn't, but in another different situation, so I can believe what you say.
Then anyway, beyond the 30 days from the last estimated delivery date, there are complaints with paypal (if the buyer paid with paypal) and those with the credit institution (chargeback) and for an item not received confirmed by tracking there aren't many chances of being right....
Kind regards.

·1 year agoGood evening Flavio
I saw that in your auctions on postcards you are offering postal rate 1
Question: Have you checked whether the delivery outcome for this postcard showed a positive result?
Have you tried contacting the buyer to ask why they left positive feedback and then opened a dispute with PayPal or with their credit institution?
The 30 days are offered by eBay as buyer protection.
Then however a buyer still has one or two cards up their sleeve in case of post-purchase problems.
PayPal or the credit card.
If they paid with PayPal, they have up to 180 days to open a claim.
If they paid with PayPal or directly with a credit card, the buyer can also eventually open a claim with their bank to dispute the payment because they did not receive the item purchased; in this case, up to 13 months are available.
Kind regards.

OP1 year agoGood evening and thank you for your message.
So yes, I sent him a message about 4 hours ago but he still hasn't replied, hopefully he will.
I don't have the tracking anymore, because that square receipt they give at the Post Office after
you pay for Posta 1, which also has the code, I keep it until everything is going well with the shipment.
Once the buyer left me the review I threw it away automatically.
What mainly matters to me is not to have negative consequences with Ebay,
in terms of penalties like suspended promotions or negative feedback.
Things that, however, I understand there cannot be since the positive review
has already been left, and in any case a review can be made within either 60 days or 90 from the date
of purchase (we are beyond both here). Can you kindly confirm this for me?
Thank you,
Flavio

·1 year agoUsually Posta 1 is quite fast in delivering.
It could happen that the envelope ends up somewhere in the office and then is found again after a few months (this happened to me).
It could be that the buyer requested a chargeback for a payment they maybe didn’t remember, so the case was started in the meantime.
I advise you to always enter the Posta1 code in the item tracking, since the eBay system is able to show when Posta1 has been delivered.
You will receive a refund request from Ebay, you reply that the buyer left you positive feedback and never opened any complaint on Ebay and never even wrote to you to complain about the item not being received.
If you manage to recover the Posta1 code it would be better because by attaching it to the request you would have had more chances of success.
It’s not certain that they will side with you, as the dispute could be generic and not connected to the receipt of the envelope but maybe to an incorrect purchase or an item not as described.
Keep us updated.
Best regards

·1 year agoThere will be no consequences with ebay if ebay has the possible ability to take money from your account/card to refund the buyer.
The only downside will be refunding the buyer.
Regarding the feedback:
You can leave feedback within 60 days from the date you received the item or from the estimated delivery date, whichever comes first.

OP1 year agoThanks for the clarifications and the VERY VALUABLE advice, above all the one about entering the Posta1 code
from now on in orders. I forgot to mention that he is NOT asking for the amount back, he says he still wants the postcard, so what you suggested about the item not matching or an incorrect purchase should not apply, precisely because he reiterated that he wants the item.
So could you very kindly confirm before we leave each other, whether I have understood these 2 fundamental things correctly:
1. that since I have already left positive feedback and 90 days have now passed from the date of
expected delivery, the buyer can no longer change the feedback and so I won't get a negative one?
2. That in the worst possible case, the most that could happen is having to refund
the amount?
Thanks again

OP1 year agoGood evening,
brief update.
The buyer replied, saying that he made a mistake with the order and that the dispute for
item not received was actually supposed to be for another purchase; now he has closed this one for me.
Thanks again ENORMOUSLY Heavenwelkin for the excellent advice, which I will put into practice.
Happy Sunday,
Flavio
