Good evening, dear members of the forum. I’m here to ask for your help with a rather unpleasant matter that has happened to me.
I made a sale on eBay, the item arrived not working and I accepted the return from the buyer without any problems, at my expense clearly and offering a full refund. Right from the start the buyer showed herself to be uncooperative and prone to arguing. Yesterday the return package arrived and I filmed the opening as I always do in these cases. The item arrived well packaged but, as it happens, one video game from the lot worth more than 20 euros is missing. I immediately contacted the buyer to ask for that part of the order to be returned as well and I opened an eBay case. Not only did the buyer deny it (even though I sent her the above-mentioned video on WhatsApp without receiving a reply) but she called me a scammer and left negative feedback. I kindly ask you for advice on how to proceed in this situation, since this is the first and I hope the last time this happens to me

….. even though it’s equally true that it’s not worth filing a report over 20 euros.
The video is not accepted either by eBay or, as evidence, by a serious police station because it is easily reproducible and alterable.

·1 year agoI wrote "useful" and not "necessary or essential" to file a formal complaint.
He can still state in the complaint that when he received the parcel, he recorded himself opening it.

As for eBay, filmed evidence has no value, so in the appeal you can't include the video of opening the package.
Appeal requests, even with a complaint attached, don't necessarily succeed, so you need to try to convince the buyer that it's not worth getting a complaint over 20 euros.

in the link I sent you, you are asked to also attach a "copy of the report filed with the competent authorities"
Before filing the report and opening an appeal, you can try to get the buyer to come to their senses, but you have to do it in eBay messaging, not on WhatsApp because it has no legal value.
Contact them via eBay chat and tell them you will file a report, as written in eBay's appeal rules.
If you're lucky and maybe the buyer tells you that, in fact, upon checking more carefully, they forgot to include it, this is additional proof to attach to the appeal you will file.

OP1 year agoThanks a lot for the kind reply, unfortunately even though I appealed, eBay ruled in the buyer's favor. I was negatively surprised by the customer service's inability to help me; 3 out of 3 agents told and advised me different things, and the last one practically hung up on me. It's only 20 euros and I won't take it any further, but I definitely understood that the seller on this platform has very few protections.
