I received from the bank information about a direct debit for a recurring transaction from Ebay s.a.r.l.
Is this normal?

·1 year agoThere is a note from the Bank of Italy that says it is not possible to cancel a Sepa mandate without the creditor's authorization.....
How can a consumer revoke a mandate for SEPA direct debit?
According to the guidelines of the Rulebook SDD, if the debtor wishes to revoke the mandate for SEPA direct debit, they must contact the beneficiary counterparty, unless otherwise agreed between the parties.
(from: https://www.bancaditalia.it/compiti/sispaga-mercati/sepa/faq-sepa/faq-sepa.html?dotcache=refresh#faq8761-57)
However, there is a ruling by the banking and financial arbitrator that states the opposite ... https://www.dirittodelrisparmio.it/2024/02/18/revocabilita-mandato-sepa/
So I would send a registered letter with return receipt to both ebay and my bank asking to cancel the mandate.
But this does not mean that you can avoid paying any debt, only that you can do so with other methods.

·1 year agoGood morning, I strongly advise anyone against giving their IBAN to Ebay in order to become sellers, because then they open a direct debit on your current account, which authorizes them to withdraw money in the event of disputes. The bank cannot remove it and Ebay does not remove it even once their account is closed! I say this from direct personal experience. I closed my Ebay account with their promise that the direct debit would be removed, but after a month since closing, and countless appeals and follow-ups, I still haven’t managed to get it removed!!! I was told that I had been the one to authorize them, but they are unable to provide me with the document or the step in which I would have authorized them!!! I had to call my lawyer and, if I do not get a positive response from them soon, I will have to take legal action against them, both for having activated the said direct debit and for still not having removed it following the closure of my Ebay account!

·1 year agoDear mausun
Signing a contract as an ebay seller entails obligations and restrictions.
Signing an online contract is not a game, these are REAL contracts like physical ones signed by hand.
If you have an active SEPA mandate on your account, you need to contact your bank.
If your bank is unable to revoke the mandate (unfortunately with some banks this does not work), the problem does not arise anyway because ebay does not withdraw money RANDOMLY, so you can close your ebay account and live peacefully.
If ebay has withdrawn money from your account, it is because you had a dispute that was closed against you, or you had a chargeback or a paypal dispute.
Once the dispute situation is resolved, ebay will not withdraw any more money from you.
If this sepa debit is bothering you and you can't get it removed, I recommend changing your current account.
If it's a postepay evolution, close the account and open another one, then close the ebay account.
Putting a lawyer in the middle for a contract that you yourself signed seems nonsensical to me.
Best regards.

·1 year agoGood morning, when I realized that a direct debit had been set up on my bank account, I asked eBay support how to revoke/remove it. I was told, clearly and on more than one occasion, that the only way was to close my eBay account. Unfortunately, that did not happen. After the 2 months had passed since my request to close my eBay account, I received communication that the account had been permanently closed, but the direct debit is still active to this day. In essence, I followed eBay’s procedure and instructions, but eBay did not stand by its word. Now I’m even being told/advised to change bank accounts in order to remove this direct debit! Also, advised by my lawyer, I recently asked eBay support to show me exactly at which step I had authorized them to set up the direct debit, and they were not able to provide any proof or any "signed" document showing that. Obviously I don’t doubt that eBay can take money from me at random, but I don’t understand why, just as they set up the direct debit for me, they are so stubborn about not wanting to deactivate it! In practice, they pushed me to close a ten-year-old eBay account, with dozens of positive reviews, for nothing, since it was they themselves who assured me that was the only possible solution to revoke their direct debit! At this point, I will certainly do everything I can to have my rights upheld and finally get rid of this direct debit, through my lawyer if necessary. I’m leaving this testimony of my personal experience with eBay so that it is known what it entails to go along with the procedure in order to become eBay sellers. Everyone can then decide for themselves whether the fact of being unable in any way to get rid of a bank direct debit with them is a reason to "live peacefully" or not. I will update this post if eBay takes steps to honor the words spoken by its own support team. Regards

·1 year agoCall centers are limited in what they can do; they can’t receive attachments, browse websites, provide documentation, or give technical opinions.
Very often the operators of a call center are not part of that company, they are located abroad, and they can only act within a certain "range" .
They deal with providing basic assistance for the most common and trivial problems a user may encounter when using the platform.
So they should say they don’t know certain procedures, rather than making them up. And then direct the issue to the appropriate department, if there is one.
I’ll give you the first example that comes to mind: A seller has sold a certain number of items and decides to stop and close the account. Ebay closes the account but leaves the direct debit active. Some buyers after 6, 8, or 12 months have a problem with the item and open a chargeback request with their bank. In that case, through the active direct debit, Ebay can draw from the former seller’s funds.
Are you kidding me? For an item sold used between private individuals, the buyer has a problem after 6, 8, or 12 months and Ebay would take the money from the seller’s checking account? Does that seem normal to you? Not even for new items bought in a store would they refund your money after so long.
You simply spoke with an operator at a call center, maybe in Tirana (Albania); if you had spoken with another operator, maybe they would have told you something different, or maybe the same thing, but what were they supposed to tell you?
Call centers are not specialized / authorized to provide technical details about how something works or about the clauses of a contract.
They are trained to answer recurring questions about problems using the platform.
I spoke with Ebay customer service operators. Who else was I supposed to talk to?
Good luck.
If you have closed the ebay account and don’t have any pending sales for over 13 months, I’d advise you to leave everything as it is.
Ebay doesn’t take money from you at random, so no one will take a cent from your checking account.
From your lips to God’s ears. I’m not giving up. Regards

·1 year agoHeavenwelkin was not kidding, credit cards offer their customers purchase protection for up to 13 months.
Private individuals are not subject to the legal warranty on the products they sell, but they are still subject to the warranty of conformity provided for by our civil code.
So if the buyer states that, within a year, they found that the purchased product has a lack of conformity, they can ask (within 30 days) their bank to cancel the sales transaction (cancel the payment).
Since today platforms intermediate payments, they must refund the buyer and then they recover the money from the sellers.
This is why they try to keep access to their bank accounts open for as long as possible, while also bearing in mind that even if the accounts are closed they can pass the ball to a debt collection agency.

·1 year agoSo Ebay will remove the direct debit after 12 months from the closure of my Ebay account? Or from my last sale?

·1 year agoPutting items up for sale on ebay without having this kind of knowledge / awareness is not a good thing.
It was probably a good thing that you closed the ebay account; you would have risked being traumatized by any unfavorable outcomes on some sale.
The mistake almost all of us make is not reading the terms and conditions of any service before clicking on "accept".
We get outraged when we find out that that app downloaded on the smartphone takes photos, activates the microphone and sends a whole series of data, including our location, to an xyz server without our permission, when all of this is clearly stated in the app's terms of use that we accepted.
Let us know if you manage to revoke the SEPA mandate.
Best regards.

OP2 years agoThanks. I’m surprised I got this communication after 9 years of sales…

·2 years agoIf you're a regular seller, meaning you've sold consistently over these 9 years, you will certainly have realized that at a certain point eBay removed PayPal from direct payments to the seller and inserted itself between them.
Starting around 2021, in order to keep selling on eBay, you had to enter a bank account.
I can only see up to August 4 for expired sales.
I'm surprised the bank sent the communication only at the end of October when, in theory, by August 4 you should already have been enabled for payments with IBAN and bank direct debit in order to sell, so this communication from the bank should have arrived already in August.
Best regards.

·2 years agoYes, it's NORMAL, it's standard practice, in order to sell on eBay you have to give eBay authorization for automatic withdrawals when needed.
