Seller
Good morning, to my surprise I have to report the incomprehensible behavior of this seller, from whom I bought a mini pressure washer to clean my MTB, the price was really minimal (€ 24,99), I wasn’t expecting much, but at least that it would work. Unfortunately the item didn’t work, besides arriving very late compared to the expected delivery, I informed the seller who had shown himself willing to exchange it and I was too, but after the message exchange, no one showed up anymore, after a day I requested a refund which was immediately accepted. From then on this seller had an arrogant and hostile attitude toward me, calling me dishonest and threatening to turn to the Carabinieri and lawyers to report me, for the delay (according to him) in returning the item, implying that if he hadn’t followed up I would not have returned the item, a delay simply due to the fact that I was away from home for personal reasons and I certainly did not take his "precious" pressure washer with me, moreover within the times set by eBay rules. In any case, the item was sent back to the sender and this "gentleman", definitely unfit to be a seller, for his downright unacceptable attitude, from whom I advise not to buy, continued with his insinuations and threats. I am running out of patience and since the threats are written down I am considering whether to take legal action against this person, but since it is nonsense I will probably let it go. I also suggest that eBay be wary of certain people who do nothing but discredit the good work of other serious and reliable sellers on the site.

OP2 years agoGood morning,
I’m coming back again to the issue mentioned above, despite the seller having made sure not to send me the return label for the item, with all kinds of excuses and threats of legal action (I don’t know what he could possibly have reported), I arranged the return out of my own pocket with a standard shipment via Poste Italiane, sent on 17-06-2024. Today the package came back to me marked as unknown address, even though the address is correct, complete with the seller’s phone number. Now, not being familiar with eBay procedures, I don’t know how I should proceed; in any case, at this point, I’m asking you how I should move forward, as I will not be making any new shipments at my own expense. In any case, I am forced to inform AGICOM via certified email to protect my rights and avoid hassles (also because we’re talking about a paltry 24.99 euros), since the seller has been quite threatening as well as very rude.

·2 years agoThe certified email to AGCOM is useless, the communications regulator isn’t interested in your case.
Use the online report form at AGCM (the competition and market authority).

·2 years agoHas 30 days passed since it arrived? If so, with eBay you're too late to open a dispute for an item not as described; however, you can open one through PayPal or do a chargeback with your credit card.
gianniscuriatti
OP2 years agoThanks for the suggestion, however I would like to point out that I got the refund back immediately through Pay Pal, then I took care of sending the item back at my own expense since the seller did not send me the return labels, even though the shipping details were correct and I provided the seller with the tracking number, the package was sent back because the recipient was unknown.
So I did everything that was necessary for the return , at this point the item is available at my home, if the shop owner wants it back they will take steps to get it, otherwise once the legal deadline has passed it will end up in the dumpster.

·2 years agoThe item is available at my place; if the seller wants it back, they’ll take steps to get it back, otherwise once the legal deadlines have passed it’ll end up in the bin.
I’d say that’s the best solution; if he wants it back, he pays.
If you had used eBay (within the 30-day available period), your return shipping costs were also refunded, whether the seller accepted it or not. It’s not like that with PayPal, and I don’t think the "rule" still applies that up to €25.00 (or €15.00, I don’t remember) PayPal would directly refund the return shipping costs too. Still, you can try asking them.

OP2 years agoThe communication about the defective item and the relative refund were immediate, since I paid with PayPal. The seller, instead of sending the return label with postage paid by the recipient, started threatening legal action if I didn’t send the item back at my own expense, contrary to what is предусмотрed by eBay’s rules. In my chat with the seller, I repeatedly stated my willingness to return the product as soon as he provided the relevant return label with postage paid by the recipient.

·2 years agoNo need to get angry or start arguing
You simply need to open a case for item not as described:
https://www.ebay.it/help/buying/returns-refunds/restituisci-un-oggetto-cambio-di-un-rimborso?id=4041
Go here and activate the process by following the instructions to the letter.
In a nutshell, the seller has a set number of days to provide you with a return label at their expense; after that, if they don't, contact eBay and get refunded directly.
Kind regards.

OP2 years agoBut not being familiar with eBay returns, I sent the “package” via Poste Italiane at
my own expense.
Anyway, I won’t buy on eBay anymore, as the return procedures are
rather complicated, Amazon is much better.

·2 years agopremising that everyone is free to "migrate" to other marketplaces ( where, of course, they then have to find out about the relative rules..... ) , I would like to point out that buyers too ( without naming names....... ) tend to say their "own" truth ( maybe "omitting" some important data...... ) ;
also : reading the feedback they left raises some doubts for me........
another thing : mentioning the name ( in the text or in the heading..... even craftily) of another user is not allowed in community.......
gianniscuriatti
OP2 years agoLook, you don't know me, so I don't accept your reconstructions, I can assure you that I certainly don't go around arguing over an item worth 24.99, if you then have doubts that's your problem, also because of everything I bought on ebay I have never returned anything.
If you want to clear up the doubts, go and look at the exchange of messages on the ebay chat and the tone and manner used by the seller, who made sure not to inform me about how to make the return. That said, the item that I sent back at my own expense to the seller via Poste Italiane, today came back because of unknown address, even though I clearly indicated the address, the phone number, and I sent the merchant the shipping number to track the shipment .
At this point I will send a new message to the seller, pointing out that the item is available at my home and asking them to contact me for the return at their expense; after the legal period, the package will end up in the trash bin.
Anyway, thank you for the trust you have shown and I wish you a good evening.

·2 years agoreconstructions or not, everyone makes their own considerations on a public forum: so, reaffirming what I wrote previously, I point out once again that on the community it is NOT allowed to name users’ nicknames in order to discredit them (the fact that he wrote it in the post title seems to me like a “clever trick” that went unnoticed by the moderator ........ )
in short: if you don’t like the answers given or you don’t read them, either, or you avoid posting in a user forum..... unless you want to answer yourself......
as for the answers to your question, they have already been widely given by other users: all of this, however, shows a poor knowledge of eBay procedures, confirming the fact that you write verbatim
"If you want to clear up the doubts, go and look at the exchange of messages on the eBay chat " : apart from the fact that disputes must be resolved by eBay, a little reasoning is enough to understand that the only ones who can read those chats are the interested parties (and therefore, seller, buyer and eBay support .....), since they are not public......

OP2 years agohaving ever returned anything I bought on eBay, I never
had any need to turn to the forum. So out of pure ignorance
of how things worked, I mistakenly mentioned the shop name.
Having said that, I ask you not to pass judgment on people you don't know,
I never allow myself to judge people I know, let alone people I
don't know, and I ask you to do the same. The facts are as I presented them,
not a comma more, not a comma less, also because believe me for a miserable 25
euros I really don't feel like arguing. In any case, I have already
taken steps to protect myself with the competent authorities and although I notified the seller more than
once that the item is at his disposal for the return, he made sure not to
send me the relevant label for the return carriage paid. One
thing is certain, in the future I will make sure not to shop on eBay.

·2 years agoDear gianniscuriatti
There’s no point in getting angry, stubborn, or losing your temper with the seller when you decide to open a dispute for an item not as described.
From that exact moment on, the seller no longer has any say because the seller and the buyer must follow the instructions / guidelines provided by ebay.
I hope it doesn’t happen again, but if you should ever have a similar problem again, please remember to write on the forum BEFORE opening a dispute because, as you RIGHTLY said, disputes are not simple procedures but NECESSARY ones because online sales have become a COMPLEX matter.
Kind regards.

·2 years agoYou came to the forum to complain after the “mess was already done,” and for this reason the forum wasn’t able to help you.
If you had chosen to write on the forum before doing things by “feel,” we could have guided you toward the right path to follow.
Not to mention that besides the forum there is eBay’s official support, which you can talk to by phone or via chat for any doubt or request for assistance.
Next time you see something of interest that you won’t find elsewhere and/or at the same price, you’ll buy on eBay again.
eBay works well and protects buyers; the important thing is to follow the return procedures correctly.
Kind regards.

OP2 years agoThanks for the suggestions, but having never returned anything from purchases made on ebay I acted on impulse and rather than put up with that guy’s invective I sent everything back at my own expense (9 euro), doing a good deed. In any case I tried to report the guy’s improper behavior, but every time I clicked to send the message, a window opened telling me that there were problems at that moment and inviting me to try again later. I tried several times and at different times, but the result was always the same, until I got fed up. Sorry to say it but ebay customer service does not exactly shine for efficiency, and that is why, to avoid the problems described, I will not buy anything on ebay anymore, so the problem is solved at the root.

·2 years agoInitially, registering on the platform was complicated and not easy to do. The site was completely dedicated to international collectibles purchases, and it offered a range of unusual and even rare products. There were no consumer products at all. The platform was specialized. And when something isn’t mass-market, there’s already a sort of automatic selection. Then, for many reasons, about 14 years ago the doors were thrown open to professional sales and everyday consumer goods. Gradually, collecting became less and less relevant until it occupied a small sphere of very narrow interest. In this light, where widely used products have greater priority, serious and honest buyers and sellers must necessarily see transactions in a different way. No longer as selective as before.
It’s like the TV show 'La Corrida' from years ago, where amateurs and non-amateurs alike would try their hand at all kinds of sketches, sometimes comic, sometimes tear-jerking, to entertain a mixed crowd with modest tastes. You can find absolutely anything. It’s a sort of activity that can often seem like a pantomime open to anyone who wants to get involved. That’s why for many products it’s better to buy them in a shop.
And to forget the misleading idea of the good price, which too often leads to a myriad of unexpected problems. Best regards from von
