Good evening. Our eBay shop sells motorcycle spare parts and accessories, mostly vintage. Many companies no longer exist and some items no longer have their original box. How should we handle this for the GPSR?

·1 year agoThe issue with the regulation is precisely that of items produced between 1926 and July 1993 (CE marking requirement). You need to follow the directive’s rules:
“The ‘GPSR’ applies, in particular, to products – new, used, repaired or refurbished – placed or made available on the market, where there are no specific Union provisions aimed at regulating the safety of the products in question; ...........
In general, according to the definition provided by Article 3, no. 2, EU Reg. 2023/988, a product is safe if “under normal or reasonably foreseeable conditions of use, including the actual duration of use, it presents no risk or only minimal risks compatible with the use of the product, considered acceptable and consistent with a high level of protection of consumers’ health and safety”; otherwise, the product must be considered dangerous.
As already said, only CE-compliant products and those falling under Annex IX are exempt (antique products over 100 years old). Only in these cases can you omit the information, while in the other cases you become responsible for placing it on the market and you must provide all the required information.
