Dispute Negative feedback
Good evening, on 3/12/2023 I bought a part for my car that’s in repair on eBay.
once I identified the part, I contacted the seller to ask about compatibility and shipping times.
on the listing it said it would be delivered between 12 and 13 December, in the same chat I asked the seller if those were really the delivery times (simply because the part was really urgent) and his answer was 24/48h now considering that when I
ordered it, it was Sunday evening, I thought “it’ll arrive on Wednesday”, so I ordered it.
Wednesday the part hadn’t arrived, I had to get it from 50 km away from my home, spending another €90, the part was delivered on Friday, and it was totally useless.
I proceeded with the return, and I left negative feedback reporting the lack of seriousness.
the seller contacts me with a threatening tone, threatening legal action against me through a lawyer.

Mentore2 years agoIf you wrote saying the lack of seriousness, he would have every right to sue you for aggravated defamation.
In feedback, you have to limit yourself to an objective description of the facts: the ordered item arrived two days late compared to what was stated in the listing.
You don’t even know whether the problem depends on the seller or the courier (given the period, that’s very likely) and you cannot draw from your specific case your own subjective considerations that (in your opinion) can be extended to the generality of his sales (lack of seriousness on the seller’s part).
By doing this you have committed the offense of aggravated defamation (art 595 c2 penal code), proceedings are brought only on complaint by the offended party and, in my opinion, the seller will hardly carry out his threat (you should know, though, that if he wants to, he can).
