Used e-bike sale

I’ve had an Italian ICONE ebike up for sale for quite some time. A few days ago I find out that the listing was suspended by ebay on the excuse that it’s not possible to sell used micromobility products because they have a “used” battery and charger!
Granted that even having read the reasons communicated to me by ebay, I don’t understand why all of a sudden electric bikes can no longer be sold, what I don’t understand is why there are still hundreds, if not thousands, on the platform still for sale. These are used electric bicycles, sold by private individuals, as in my case. Could someone explain to me what happened?

Mentore4 months agoFor example: if you're on the highway and you're driving over the speed limit and you get a ticket, what do you do, do you complain to the traffic cops "but there were vehicles going faster than me anyway?"

OP4 months agoI have to say that your response is as thorough as it is useless! I really just can’t understand the point. I asked the community for clarification on an eBay rule that I can’t understand and on the fact that the same standard is not being used for all listings similar to mine, and you come along with a pointless comparison that I find extremely stupid and offensive! Is there anyone in this community able to answer comprehensively? eBay customer service nowadays only has automated response systems managed by AI that isn’t able to answer beyond what has been “set” by the system. So the community becomes the only resource, but if these are the answers…

Mentore4 months agoSika may have been rude, but he didn’t get the comparison wrong. If the sale of an item is prohibited, you can’t use the excuse that there are other ones for sale anyway.
There are millions of listings and when irregular listings are found, they are removed.
The reason platforms should not allow private individuals to sell used micromobility devices comes down to Extended Producer Responsibility (EPR), a European regulation, transposed in Italy (Legislative Decree 116/2020), which obliges whoever places a product on the market to take responsibility for its entire life cycle, including waste management (packaging, WEEE, batteries, textiles). Since ebay cannot check whether these products were placed on the market in compliance with the regulations, it forbids their sale to anyone who is not pre-authorized.

OP4 months agoThe European regulations it refers to deal with the management of the battery production cycle and concern exclusively manufacturers and distributors of goods using "batteries". The buyer is not obliged to check whether the bike is compliant (besides, they don’t have the tools to do so!) but must only check that everything is fiscally correct, as in my case. Since I bought the bike from an official dealer of a brand "officially" distributed in the national territory, I have the fiscal receipt that proves the regularity of the bike and the sale; after that, all that’s left is to enjoy the item purchased! When reselling, if you’re unable to certify that the item was regularly purchased and certified, you could ask the seller to provide suitable purchase documentation and not brutally delete the listing (without, moreover, any communication!). And I repeat what I already wrote: if the goal is to protect yourselves regarding the lack of certification, then not only electric bikes should disappear from your platform, but also laptops, smartphones, tablets, and even cordless electric brooms! On the first part of what I wrote, I was simply wondering why there are still many used electric bikes on the platform sold by private individuals, some clearly counterfeit (oversized batteries, motors with more than 250W of power, modifiable controllers!) that are still online for sale and, considering that you’re massively using AI to sweep the content, I find it hard to swallow that my bike, an Italian brand regularly distributed in the territory, fully compliant with CE regulations, was removed without any chance of appeal and without dozens of other bikes (including those I reported more than a week ago) being removed as well!
